KENNETH FLEAGLE ~i~'-- NEWPORT-WASS STREET ANNEXATION NO. 132 RECOMMENDED ACTION: Adoption of Resolution No. 82-90, scheduling a protest hearing for 3:00 p.m. January 17, 1983 for the proposed Newport-Wass Street Annexation No. 132. BACKGROUND: The City Council made application to the Local Agency Formation Commission on behalf of property owners and voters residing in the 3.27 acre area bounded by Wass Street and Elizabeth Way. The Local Agency Formation Commission conducted a public hearing on December 8, 1982 and no protests were presented. Since this is an inhabited annexation, a protest hearing is required. I have been informed by the property owners and voters within the area that there will be no protests against the annexation, but the protest hearing before the City Council is a requirement of law. KF:dmt RESOLUTION NO. 82-90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, INITIATING ANNEXATION PROCEDURES AND SCHEDULING A HEARING FOR THE ANNEXATION OF CERTAIN INHABITED TERRITORY DESIGNATED AS NEWPORT-WASS STREET ANNEXATION NO. 132 TO THE CITY OF TUSTIN WHEREAS, an application was made to the Local Agency Formation 6 Comission by the City Council of the City of Tustin, on behalf of property owners and registered voters of the area bounded by Elizabeth Wa.v on the 7 east and Wass Street on the north, for the purpose of creatin9 logical service boundaries and communiSy identity. 8 WHEREAS, the proposed territory is within the City's sphere of 9 influence and is more fully described by Exhibit "A" attached hereto and a part hereof; and 10 WHEREAS, the City Council and the Board of Supervisors of Orange 11 County have agreed to the exchange of property taxes in accordance with the Master Tax Agreement dated October 25, 1980; and 12 WHEREAS, the Local Agency Formation Commission conducted a public 13 hearing on December 8, 1982 and authorized the City Council of the City of Tustin to be the conducting authority to initiate annexation proceedings 14 for the proposed inhabited area; 15 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN DOES HEREBY RESOLVE AS FOLLOWS: 16 SECTION 1. A public hearing on the proposed Newport-Wass Street 17 Annexation No. 132 to the City of Tustin will be conducted on January 17, 1983 at 3:00 p.m., or as soon thereafter as the City Council meets in 18 regular session on that date, in the Council Chambers, 300 Centennial Way, Tustin, California. 19 SECTION 2. Any owner of land or any registered voter within the 20 territory proposed for annexation may file a written protest with the City Clerk at any time prior to the conclusion of the City Council hearing on 21 the proposed annexation. 22 SECTION 3. The City Clerk shall cause notice of hearing on the proposed annexation to be given as required by law. 23 PASSED AND ADOPTED by the City Council of the City of Tustin at an 24 adjourned meeting held on the~day of , 1982. 25 26 27 ATTEST: RICHARD B.
