WYNN, CITY CLERK RESOLUTIONS REGARDING APRIL 10, 1984, GENERAL MUNICIPAL ELECTION RECOMMENDATION: Adoption of Resolutions' No. 105, 106, and 107. BACKGROUND: Pursuant to the provisions of the laws of the State of California, the next General Municipal Election for the City of Tustin shall be held on April 10, 1984. In the course of conduct of the election, the following attached resolutions need to be adopted: RESOLUTION NO. 83-105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, APRIL 10, 1984, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES RESOLUTION NO. 83-106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO RENDER SPECIFIED SERVICES TO THE CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF TUSTIN ON TUESDAY, APRIL 10, 1984 RESOLUTION NO. 83-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO THE ELECTORATE AND THE COSTS OF THE CANDIDATES STATEMENT FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, APRIL 10, 1984 This election is being held for the purpose of electing the following: Three (3) Members of the City Council One (1) City Clerk December 19, 1983 Page 2 Nomination papers may be taken out and/or filed between the dates of January 12, 1984, and February 2, 1984, except that if an incumbent does not file by the closing date, the February 2, 1984, date is extended for five days (February 7, 1984) for any candidate except the incumbent. W~mn City C1 erk 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 83-105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF llJSTIN, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, APRIL 10, 1984, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY .THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES WHEREAS, under the provisions of the laws relating to General Law Cities in the State of California, a general municipal election shall be held on April 10, 1984, for the election of Municipal Officers: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities within said State, there is hereby called and ordered held in the City of Tustin, California, on Tuesday, April 10, 1984, a general municipal election of the qualified electors of said City for the purpose of ~ecting three (3) Members of the City Council of said City for the full tem of four years; and one (1) City Clerk of said City for the full term of. four years. SECTION 2. That the ballots to be used at said election shall be, in for)n and content, such as may be required by law to be used in the elec- tion. SECTION 3. That the City Clerk of said City is hereby authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 4. That the polls for said election shall be open at seven o'clock a.m. of the day of said election and shall remain open contin- uously from said time until eight o'clock p.m. of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 5. That in all particulars not recited in this Resolu- tion, said election shall be held and conducted as provided by law for hold- ing municipal elections in said City. SECTION 6. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election, in time, form and manner as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, on the 19th day of December, 1983. MAYOR UIIY CLERK RESOLUTION NO. 83-106 2 3 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO RENDER SPECIFIED SERVICES TO THE CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF TUSTIN ON TUESDAY, APRIL 10, 1984 WHEREAS, a General Municipal Election is to be held in the City of Tustin, California, on Tuesday, April 10, 1984; and WHEREAS, in the course of conduct of the ~ection it is necessary for the City to request services of the County; and WHEREAS, all necessary expense in performing this service shall be paid by the City of Tustin; 10 1I 12 13 14 15 16 17 18 19 20 21 22 NOW, THEREFORE, THE CITY COUNCIL-OF THE CITY OF TUSTIN, CALIFOR- NIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION i. That pursuant to the provisions of Section 22003 of the Elections Code of the State of California, this City Council requests the Board of Supervisors of the County to permit the Registrar of Voters to prepare and furnish to the City for use in conducting the election the com- puter record of. the names and addresses of all eligible registered voters in the City in order that the City may print labels to be attached to sel-f- mailer sample ballot pamphlets; and will also furnish to the City printed indices of the voters to be used by the precinct board at the polling place; and will make available to the City additional election equipment and assistance according to state law. SECTION 2. That the City shall reimburse the County for services performed when the work is completed and upon presentation to the City of a properly approved bill. SECTION 3. That the City Clerk is directed to forward without delay to the Board of Supervisors and to the Registrar of Voters, each a certified copy of this resolution. PASSED, AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, on the 19th day of December, 1983. 23 25 MAYOR 26 27 CI I¥ CLERK 28 RESOLUTION NO. 83-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO THE ELECTORATE AND THE COSTS OF THE CANDIDATES STATEMENT FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, APRIL 10, 1984 WHEREAS, Section 10012 of the Elections Code of the State of California provides that the governing body of any local agency adopt regulations pertaining to materials prepared by any candidate for a municipal ~ection, including costs of the candidates statement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. GENERAL PROVISIONS. That pursuant to Section 10012 of the Elections Code of the State of California, each candidate for ~ective office to be voted for at the General Municipal Election to be held in the City of Tustin on April 10, 1984, may prepare a candidate's statement on an appropriate form provided by the City Clerk. Such statement may include the name, age and occupation of the candidate and a brief description of no more than 200 words of the candidate's education and qualifications expressed by the candidate himself or herself. Such statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. Such statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. Such statement may be withdrawn, but not changed, during the period for fil~tng nomination papers and until 5:00 p.m. of the next working day after the close of the nomination period. 17 SECTION 2. SPANISH LANGUAGE. The City Clerk shall have the statements translated into Spanish and shall have them available for review 18 at the City Clerk's office. 19 2O 21 22 23 24 SECTION 3. ADDITIONAL MATERIALS. No candidate will be permitted to include additional materials in the sample ballot package. SECTION 4. PAYMENT. The City Clerk shall estimate the total cost of printing, handling, translating, and mailing the candidate's statements filed pursuant to the Elections Code, and require each candidate filing a statement to pay in advance his or her pro rata share as a condition of having his or her statement included in the voter's pamphlet. The City Clerk shall bill each candidate for any cost in excess of the deposit and shall refund within 30 days of the election any unused portion of the deposit. 25 26 27 28 SECTION 5. That the City Clerk shall provide each candidate or the candidate's representative a copy of this Resolution at the time nominating petitions are issued. SECTION 6. That this resolution shall apply at the next ensuing municipal election and at each municipal election after that time.
