BACKGROUND Cai-State Associates, Inc., owner of the Californian apartment complex at 14882-14942 Newport Avenue, received approval from the Planning Agency in 19B2 {Variance 81-8) to convert and subdivide the Californian apartments into condominiums. The Tentative Map was approved on June 7, 1982 and is due to expire on December 7, i983. ANALYSIS Cai-State Associates applied for a one-year extension of Tentative Tract Map No. 10300 to the Planning Commission who approved said request and recommended certification of this action by the City Council, Concur- rently, the land use approval, known as Variance 81-8 which permitted the conversion, has since been revoked by the Planning Commission. Since the land owner has cooperated with the City by not opposing termination of Variance 81-8, staff recommended approval of the extension request. The Commission, however, imposed a six-month review to assess input concerning the sale of the apartment project or new conversion application. Staff further recommended an additional condition be included in Tentative Map approval to read as follows: "That use permit approval for the multiple-family residential project must be approved prior to final map approval and recordation." While a valid Tentative map may be preferred by the property owner, it is valueless without a new use permit being issued for the condominium conver- sion. Therefore, since extension of the Map should not be detrimental to the com- munity, such action may be considered at this time. 2 3 4 5 6 7 8 9 10 12 13 14 16 17 18 19 2O 21 23 24 25 26 9.7 RESOLUTION NO. 83-103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE EXTENSION OF TENTATIVE TRACT MAP NO. 10300 The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A. That Tentative Tract 10300 was submitted to the City Council by Mollenhauer, Higashi & Moore, Inc. on behalf of Cai-State Associates pursuant to Ordinance No. 847 for the purpose of creating six {6) numbered and two (2) lettered lots for residential condominium purposes for the property described as a portion of Lot 64, Block 11, Irvine Subdivision, Book 1, Page 8, m.m., Records of Orange County. B. That said map was approved by the City Council on June 7th, 1982 by the adoption of Resolution No. 82-39~ C. That Cai-State Associates did request an extension of said map at the Planning Commission meeting of November 28, 1983 and the Planning Commission did recommend an extension of Tentative Tract Map No. 10300 for one (1) year, subject to the following conditions: That use permit approval for the multiple-family residential project must be approved prior to final map approval and recordation. That the status of the apartment refurbishing project which is contained within the subject map area be reviewed by the Planning Commission within six (6) months of map extension to ensure satisfactory progress. II. The City Council hereby approves a one (1) year extension for Tentative Tract Map No. 10300, subject to the conditions of this resolution.
