The current land use of each lot is a single-family residence. The Local Agency Formation Commission (LAFCO) recently approved annexation of the site to the City of Tustin. All of the property owners agreed to the annexation and it was processed through LAFCO by their, representative, Richard Pierce. The Planning Commission approved General Plan Amendment No. 83-2 at its September 26, 1983 meeting, recommending a change of the land use designation to Residential Multiple-Family. The-City Council approved General Plan Amendment No. 83-2 at 1ts October 5, 1983 meeting, approving the recommended change to the land use element of the Tustin Area General Plan. The Planning Commission approved Pre-Zone 83-1 at its October 10, 1983 meeting, recommending a zoning designation of R-3 (3000). Further, the Planning Commission approved Use Permit 83-20, authorizing the construction of sixteen townhome condominium units for the subject parcels. The site is covered under Specific Plan No. 6, approved by the City Council in 1981. The County of Orange currently has a zoning designation on the subject parcels of E-4, Residential Estate District. Discussion In accordance with Section 65855 of the Government Code, the Planning Commission submits to the City Council an approved Resolution (No. 2119) which states the Commission's reasons for recommending a zoning designation of R-3 (3000). These include: The propo'sed change woUld be in conformance with the Tustin Area General Plan that authorizes the development of a multiple-family project. Pre-Zone No. 83-1 November 7, 1983 Page 2 The proposed change would be in conformance with Specific Plan No. 6, adopted by Resolution No. 81-52, and authorizes the development of a multiple-family project of one unit per 3,000 square feet. Other zoning designations that were considered by the Commission and were incorporated within the body of the staff report to the Commission included: A zoning designation of R-3 (2,900) that would allow the applicant to construct 17 units at an average of 2,985 square feet per. unit. A zoning designation of R-3 (2,800) that would allow the applicant to construct 18 units at an average of 2,820 square feet per unit. This is the zoning designation the application submitted for consideration. Council approval of either R-3 (2,900) or R-3 (2,800) will require an amendment to Specific Plan No. 6, requiring a public hearing before the Planning Commission and City Council. If the Council modifies the recommendation of the Planning Commission to approve one of these zoning designations, it should direct staff to advertize for' public hearing to amend Specific Plan No. 6. Recmmendatton That the Council accept the recommendation of the Planning Commission and approve.an R-3 (3,000) designation for Pre-Zone 83-1. Associate Planner Attachments: Resolution No. 2119 Refer' to Council staff memo for' Use Permit 83-20 for all Planning Commission reports 2 3 4 5 RESOLUTION NO. 2119 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN APPROVING PRE-ZONE 83-1 RECOMMENDING 14452, 14472, 14492 HOLT AVENUE BE ZONED MULTIPLE-FAMILY RESIDENTIAL R-3 (3,000) UPON ITS ANNEXATION TO THE CITY OF TUSTIN The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planntng Commission finds and determines as follows: A. That a proper application, (Pre-Zone 83-1) has been filed by Richard Pierce requesting zoning designations for property located at 11452, 14472, 14492 Holt Avenue upon annexation to the City of Tustin. B. That a public hearing was duly called, noticed and held on said application. C. That R-3 (3000), Multiple-Family Residential, should be granted for the following reasons: 1. The proposed change would be in conformance with the Tusttn Area General plan that authorizes the development of a multiple-family project. 2. The proposed change would be in conformance with Specific Plan No. 6, adopted by Resolution No. 81-52, and authorizes the development of a multiple-family project of one unit per 3,000 square feet. D. Development of subject property shall be in accordance with the policies adopted by the City Council, Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvements requirements as administered by the City Engineer. E. Final development plans shall require the review and approval of the Community Development Director. F. A previous Negative Declaration has been adopted as a part of Specific Plan No. 6. II. Any project within the subject site shall comply with Specific Plan No. 6 as adopted by Resolution No. 81-52.
