Proposed Tustin Water Utility Annexation No. 131 Tax Agreement
RECONMENDED ACTION
Adoption of Resolution No. 83-85 confirming the Master Tax Agreement for
the proposed Tustin Water Utility Annexation #131.
BACKGROUND
Annexation No. 131 for the annexation of Water Utility properties in the
County and City of Orange, is ready for filing with the Local Agency
Formation Commission.
Upon annexation, the subject properties will be exempt from taxation
pursuant to Section 202(a)(4) of the Revenue and Taxation Code.
Prior to scheduling the annexation hearing, LAFCO requires the consent of
the governmental agencies to the transfer of taxes pursuant to Section
99(d) of the Revenue and Taxation Code. ll~e City of Qrange has consented
to the Tax Transfer by Resolution No. 5740.

A.RESOLUTION OF THE CITY-COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, CONFIRMING THE MASTER
PROPERTY TAX TRANSFER AGREEMENT FOR PROPOSED
TUSTIN WATER UTILII~f ANNEXATION NO. 131
WHEREAS, a Master Property Tax Transfer Agreement dated October
28, 1983 has been approved by the Board of Supervisors of Orange
County and the City Council of the City of Tustin pursuant to
Section 99(d) of the Revenue and Taxation Code of the State of
California; and
WHEREAS, the City of Tustin has filed a proposal with the Local
Agency Formation Commission for the annexation of the territory
known as Tustin Water Utility Annexation No. 131 to the City of
Tustin.
WHEREAS, said annexation proposal consists of 11 parcels
(Parcels A-K) and a total of 3.68 acres used as reservoir and well
sites of which ten are in the unincorporated area of Orange County
and Parcel "D" is within the incorporated limits of the City of
Orange, as further described by Exhibit "A".
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Tustin that the Master Agreement providing for the transfer of
property tax revenues, as approved by the Board of Supervisors and
the City Council on November 18, 1980, is applicable to the proposgd
"Tustin Water Utility Annexation No. 131 to the City of Tustin as
undeveloped property, and said properties shall be eligible for
exemption from property taxes as long as they remain in fee and use
by the City of Tustin; pursuant to Section 202(a)(4) of the Revenue
and Taxation Code.
PASSED AND ADOPTED at a regular meeting of the City Council of
Tustin on November 7, 1983.
