ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR TRAFFIC SIGNAL IMPROVEMENTS
RECOMMENDATION:
That the Tustin City Council, at their meeting of November 7, 1983, pass
and adopt the attached Resolution accepting the works of improvement and
authorizing recordation of Notice of Completion for the following traffic
signal installations at:
Red Hill Ave. and Walnut Ave.
Walnut Ave. and Oxford Ave.
Prospect Ave. at First St.
In addition, it is further recommended that Bid Item No. 3 be deleted from the
.contract and payment be made to the contractor for materials furnished to the
City.
BACKGROUND: '
This traffic signal improvement project consists of improvements at four
intersections as follows:
Red Hill Ave. at Walnut Ave.
Walnut Ave. at Oxford Ave.
Newport Ave. at Sycamore Ave.
Prospect Ave. at First St.
The contracto~ has completed three of the four intersections, but has not been
able to Commence work on the fourth intersection, Newport Ave.and Sycamore Ave.,
due to CalTran's delay in final approval.
This action will be a request for the City to accept the improvements at the three
intersections which have been completed, and process the Notice of Completion for
same~
DISCUSSION:
All traffic signal improvements at the three following intersections have been
completed to the satisfaction of the Engineering Division:
Red Hill Ave. and Walnut Ave.
Walnut Ave. and Oxford Ave.
Prospect Ave. at First St.

The fourth intersection of Newport Ave. at Sycamore Ave. has one leg of the
intersection under jurisdiction of CalTrans. This area i~ the extension of the
off-ramp between Newport Ave. and the Costa Mesa Freeway. CalTrans is currently
insisting that the entire intersection be placed under CalTrans jurisdiction for
operational control. City staff is not in favor of Caltran's control and is
currently wSrking with Caltrans to obtain operational control of the
intersection. The delays at this intersection are a result of these negotiations
and are of no fault of the.contractor.
It is suggested that Bid Item #3 be eliminated from the contract per Section
4-1.03 of the Standard Specifications and payment made to the contractor for
materials furnished. Materials in the amount of $23,582.77 have been furnished to
the City by the contractor. The original bid amount for this intersection was
$46,000.00. The installation of this signal will be by separate contract when the
CalTrans delay has been resolved.
This delay may continue for several months and will hopefully result in the
relinquishment Of roadway jurisdiction to the City for that area between Newport
Ave. and Pasadena Ave. As a result of this delay, s~aff is requesting that three
of the traffic signal improvements be accepted by the City, by Council's adoption
of the attached Resolution, which accepts these improvements and authorizes the
recordation of the Notice of Completion.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN ACCEP'TING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF
COMPLETION
WHEREAS, D. & H. Perry, Inc.; D.B.A. Perry Electric, having

a contract with the City of Tustin to construct the hereinafter
described public work and improvement; and
WHEREAS, the City Engineer has duly certified to the
7 construction and completion of said public improvements
hereinafter mentioned in a manner satisfactory to the City
8 Council of the City of Tustin; and

WHEREAS, the City Council finds that said contractor has
completed said public improvement hereinafter more particularly
10 described in accordance with the provisions of the contract
documents and the notice of completion and acceptance of said
11 public work and improvement should be filed and payment of the
balance due said contract authorized in accordance with the
12 :ontract documents.
13 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
1~ City of Tustin that said pubic.work and improvement be, a-nd the
~ame is hereby accepted. Said public work and improvement is
1~ more particularly described as follows:
TRAFFIC SIGNAL IMPROVEMENTS AT THE INTERSECTIONS OF RED HILL
AVE. AND WALNUT AVE., WALNUT AVE. AT OXFORD AVE., AND
17 PROSPECT AVE. AT FIRST ST. AND THE FURNISHING OF MATERIALS
ONLY AT THE INTERSECTION OF NEWPORT AVE. AND SYCAMORE AVE.

AND BE IT FURTHER RESOLVED that the City Engineer of the
19 ~ity of Tustin be, and is hereby authorized to execute and file a
~otice of completion and acceptance of said public work and
20 improvement described herein as required by law.
21 PASSED AND ADOPTED at a regular meeting of the City Council
