WYNN, CITY CLERK CANVASS OF SPECIAL MAIL BALLOT ELECTION Recommendatt on: Adoption of Resolution No. 83-82 which orders the canvass of the special mail ballot election for Reorganization No. 53 to be made by the City Clerk. BACKGROUliO: A Public Hearing for Reorganization No. 53, which is a transfer of territory between the cities of Irvine and Tustin, was held on March 21, 1983, by the City Council. There were 49 protests by registered voters representing 37.4% of the registered voters within the area proposed for reorganization. On June 6, 1983, the City Council passed Resolution No. 83-22, which determined the value of written protests and ordered reorganization No. 53 and transfer of territory between the cities of Irvine and Tustin, subject to the confirmation by the voters at the next regular election to be held on November 8, 1983. Section 22932.5 of the Elections Code states that the governing body of the city shall meet at their usual place of meeting on the first Tuesday after the ~ection to canvass the returns and pass a resolution reciting the fact of the election and such other matters as are enumerated in Section 22933. To comply with this section of the code, the City Council will need to adjourn the November 7th meeting to November 15th to canvass the returns of this election. MARY E. WYNN City Clerk 1 2 3 4 5 6 7 8 9 lO 11 12 13 14 15 16 17 18 19 20 21 23 2~ 25 26 27 RESOLUTION NO. 83-82' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ORDERING THE CANVASS OF THE SPECIAl_ MAIL BALLOT ELECTION FOR REORGANIZATION NO. 53 TO BE HELD ON TUESDAY, NOVEMBER 8, 1983, TO BE ~LADE BY THE CITY CLERK WHEREAS, a special mail ballot election for Reorganization No. 53 will be held and conducted in the City of Tustin, California, on Tuesday, November 8, 1983, as required by law; and WHEREAS, the City Council of said City desires the canvass of said election to be made by the City Clerk of said city; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFOR- NIA, DOES HEREBY RESOLVE, DELARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to Section 22932.5 of the Elections Code of the State of California, the canvass of the special mail ballot election to be held in said city is hereby ordered to be made by the City Clerk. SECTION 2. That the City Clerk of said City shall prior to Novem- ber 11, 1983, complete the canvass of said election and shall certify the results to this City Council on November 15, 1983. SECTION 3. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
