HomeMy WebLinkAboutCC 5 LOT LINE ADJ 83-2 09-19-83~TE: September 9, 1983 CONSENT CALENDAR NO. 5 9-19-83 Inter_Com FROM: SUBJECT: William Huston, City Manager Bob Ledendecker, Director of Public Works/City Engineer Lot Line Adjustment #o. 83-2 (Centennial Park) Recommendation: That the Tustin City Council, at their meeting of September 19, 1983, adopt the attached resolution approving Lot Line Adjustment No. 83-2 and authorize the Mayor to sign the application for s'ame on behalf of the' City. Background: During the late 1960's, when the Tustin Meadows East Clubhouse, swimming pool, and Centennial Park were.constructed, a change was made to the size of She swimming pool, which caused encroachment within a porti.on of Centennial Park. This condition has existed since the initial construction of the facilities. Discussion: This lot line adjustment will move the common lot line 30.75 feet northerly to a location immediately adjacent to the existing fence line. The existing property line currently runs through the swimming pool. This adjustment was apparently overlooked during the stages of initial construction in the late 1960's. The Tustin Meadows Homeowners Association has reviewed this lot line adjustment and concurs with same. This lot line adjustment process is provided for in Section 66412(d) of the Subdivision Map Act wherein the act makes provisions for the local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created. The attached documents, consisting of a resolution and three sheets of an application for lot line adjustment, will provide this adjustment once the resolution has been adopted by City Council, the application approved by staff, and when all documents have been recorded by the County Recorder's office. This process and the format of these documents have been reviewed and approved by the City Attorney's office. RESOLUTION NO. 83-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 83-2 WHEREAS, Section 66412 {d) of the Subdivision Map Act makes provisions for the local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created; and WHEREAS, the City Council of the City of Tustin has reviewed Lot Line Adjustment No. 83-2 and has made a finding that the real property described in Exhibit A and shown on Exhibit B complies with the provisions of the California Subdivision Map Act and applicable City of Tustin ordinances and regulations including the requirements for building sites; and WHEREAS, the City Council of the City of Tustin has made the following findings: 1. That the proposal is eligible for processing as a lot line adjustment pursuant to Section 66412 of the Subdivision Act; 2. That the requirements of the California Environmental Quality Act have been met; 3. That the proposal is consistent with the General Plan; and 4. That the res.ultant parcels will meet the requirements of the Zoning Code; NOW, THEREFORE, BE IT RESOLVED that the proposed Lot Line Adjustment No. 83-2 as shown on Exhibits A and B is hereby approved and that the parcels be considered building sites upon recordation of this document.
