AN ORDINANCE OF THE CITY COUNCIL OF THE
2 CITY OF TUSTIN, CALIFORNIA, REPEALING ORDINANCE
NO. 1139 AND REQUIRING THAT THE CITY'S GENERAL

MUNICIPAL ELECTION, BEGINNING IN 1998,' SHALL BE
4 CONSOLIDATED WITH THE STATEWIDE GENERAL
ELECTION WHICH WILL BE HELD ON THE FIRST
5 TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER
OF EVEN NUMBERED YEARS

8 The City Council of the City of Tustin does hereby ordain as follows:

Section 1:
]0 The purpose and intent of this ordinance is to permit the consolidation of the
l I City's general municipal elections with the statewide general elections that will
be held on the first Tuesday after the first Monday in November of even
12 numbered years beginning in 1998.
]3 Section 2:
Ordinance No. 1139 is hereby repealed.
]5 Section 3:
Those elected city officeholders whose terms of office would have, prior to
]6 adoption of this ordinance, expired on the Tuesday succeeding the second
Tuesday in April of even numbered years, shall instead have their terms of
17 office expire on a date to be determined in November following certification of
]8 election results by the Orange County Registrar of Voters.
19 Section 4:
As a result of adoption of this ordinance, no term of office shall be increased
20 or decreased by more than twelve (12) months.
2] Section 5:
22 This ordinance shall be operative upon the approval of the Orange County
Board of Supervisors. Accordingly, the City Clerk is directed to transmit a
23 certified copy of this ordinance to the Orange County Board of Supervisors and
request approval of the ordinance by the Board of Supervisors.
25 Section 6:
Within thirty (30) days of the operative date of this ordinance, the City Clerk
26 shall cause a notice to be mailed to all registered voters informing the voters
of the change in election date and that as a result of the change in election
27 dates, elected city officeholders terms of office will be extended.

Section 7 (Severability):
2 If any sentence, clause, phrase, or portion of this ordinance, is for any reason
3 held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions
zl of this ordinance. The City Council of the City of Tustin hereby declares that
they have adopted this ordinance, and each section, sentence, clause, phrase
5 or portion thereof, irrespective of the fact that any one or more sections,
sentences, clauses, phrases or portions thereof be declared invalid or
6 unconstitutional.

8 PASSED 'AND ADOPTED at a regular meeting of the Tustin City Council held
on the 20th day of October, 1997.

of the City Council is five; that the above and foregoing Ordinance No. 1187

1997, and was passed and adopted at a regular meeting of the City Council
