RECOMMENDATION
It is recommended that the Tustin City Council, at their meeting of April 6, 1998, pass and adopt
Resolution No. 98-27, setting the time and place of a public heating to consider the designation and
adoption of the Red Hill Avenue Underground Utility District No. 14 between Copperfield Drive and
160'_+ north of El Camino Real.
FISCAL IMPACT
The fiscal impact will be determined at the time of the public hearing and will be identified in the City
Engineer's report.
BACKGROUND
The proposed Underground Utility District No. 14 provides for conversion of all overhead
distribution utilities to underground utilities along Red Hill Avenue between Copperfield Drive and
160'+ north of E1 Camino Real. In addition to the overhead distribution utilities being placed
underground, it will be necessary to require the undergrounding of utility services for the private
properties as follows:

As a result of a July 1990 revision of the Rule 20 proceedings, the Edison Company will now pay for
up to 100 lineal feet of each property owner's underground electrical Service lateral from the Edison
mainline to the structure requiring the service conversion. This would be the City's first
undergrounding project that this revision would apply. All previous underground projects required
the property owner to fund the cost of the undergrounding between the street right-of-way and their
structure. The only property owner expense would be the cost to have an electrician extend the
conduit and conductors from where Edison terminates at the structure to the meter service panel and
make the conversion to the underground system.

This underground district was originally proposed in late 1993/early 1994 with the northerly limit
being the Interstate 5 Freeway. Tile northerly limit of the current proposal has been expanded to
terminate approximately 160 feet northerly of E1 Camino Real. The current proposal will better
accommodate the future widening of Red Hill Avenue between E1 Camino Real and Nisson Road by
eliminating certain poles that may otherwise need to be relocated.
DISCUSSION
City of Tustin Ordinance 411 (Tustin City Code, Section 7500) authorizes the City Council to call
public hearings to ascertain whether the public necessity, health, safety, or welfare requires the
removal of poles, overhead wires, etc. within certain designated areas of the City and to consider the
underground installation of the above-mentioned appurtenances for supplying electric,
communication, and other similar services. This project will also consist of installation of new
marbelite street light poles and luminares. The project is the highest ranked project on the City's
Underground Priority List.
Ordinance No. 411 also requires the City to notify all affected property ownersand all concerned
utilities by mail of the time and place of said hearings at least ten (10) days prior to the date of said
hearing to determine whether to form an underground utility district.
The attached resolution sets the date of the public hearing for Underground Utility District No. 14 on
Monday, lune 1, 1998, at 7:00 P.M. in the City Council Chambers, 300 Centennial Way.
It is proposed to fund Underground Utility District No. 14 with City of Tustin Rule 20A monies. A
complete cost breakdown of this proposed project will be included within the City Engineer's report
for said District No. 14, which will be available at least ten days prior to the public hearing date of
lune 1, 1998.
Based upon input from the Edison International and Pacific Bell, it is anticipated that the project
would take between 12 and 16 months to complete .which includes approximately 3 months for
construction. City staff will attempt to accelerate this project as much as feasible, depending upon the
workloads of the affected utility companies.

CALIFORNIA, SETTING A TIME AND PLACE OF A PUBLIC HEARING
TO CONSIDER THE DESIGNATION AND ADOPTION OF AN

whether to form an underground utility district and of the availability of the City Engineer's
report of the details of the district in the office of the City Clerk prior to said hearing; and
WHEREAS, said notice is required to be given to the aforementioned property
owners and concerned utilities at least ten (10) days prior to the date of the public hearing;

WHEREAS, the City Engineer has advised that this report is on file in the office of
the City Clerk; and
WHEREAS, the City Council has determined that a public hearing should be set on
June 1, 1998, at the hour of 7:00 P.M. in the City Council Chambers at 300 Centennial Way

Tustin that said council hereby sets Monday, June 1, 1998 at 7:00 P.M. in the City Council

removal of poles, overhead wires and associated overhead structures and the establishment of
an underground utility district within the area of the City of Tustin generally located on Red
Hill Avenue between Copperfield Drive and 160' + North of El Camino Real as shown on a
certain map on file in the office of the City Clerk and the City Engineer of the City of Tustin.

BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized to notify
all affected property owners, if any, as shown on the last equalized assessment roll and to also
notify all utilities affected by this proposal by a notice through the United States mail of the
time and place of said hearing, and of the availability of the City Engineer's report of the
details of the district in the office of the City Clerk prior to said hearing, ten (10) days prior
to the date thereof.
