CITY FACILITY POLICY
RECOMMENDATIONS:
1. Institute a Park Reservation Fee to offset processing costs for permits and
reservations.
2. Institute an Outdoor Sound Amplification Permit Fee to offset processing
costs for permits.
3. Institute an Alcoholic Beverage Permit Fee for outdoor areas and require
clean up deposits.
Require that groups and individuals serving alcohol provide the City with a
Certificate of Insurance for $500,000 CSL or purchase an OCCRMA Liability
Policy through the City.
FISCAL IMPACTS:
Reservation fees, sound amplification, and alcoholic beverage permit fees will
generate additional revenues to offset processing costs. Insurance requirements
will have no direct fiscal impact but will provide increased liability coverage
to the City.
BACKGROUND:
The City currently operates seven parks, two parkettes, the Clifton C. Miller
Community Center, a leased school classroom facility, two conference rooms, and
its Council Chambers. Individuals and groups desiring to reserve one of these
facilities may do so through the Community Services Department. Wedding
receptions, banquets, meetings, fundraisers, picnics, softball games, and soccer
are just a few of the activities accommodated at these City facilities.
The Community Services Department developed a schedule of rental fees for City
facilities and with City Council approval, implemented a facility reservation
and rental s~tem. Interest in and awareness of the availability of City
facilities by the general public has increased. The demand for reservations at
City parks has also increased greatly, with numerous requests for company
picnics and family gatherings.

The increasing popularity and awareness of local parks has created a growing
drain on staff time to process and investigate applications for events on
City-owned parks. The Community Services Department processes the original
application and then routes it to concerned departments (Police, Fire,
Maintenance, et cetera). Staff time is required to process, coordinate, and
follow up each permit application. No fee is currently charged for park
reservations, sound amplification, or alcoholic beverage permits.
Requests for the use of sound amplification on City parks are currently reviewed
and approved by the Chief of Police, Director of Cor~munity and Administrative
Services, and the City Manager. Staff time is again required to process and
investigate these requests. There is.no fee charged for sound amplification
permits by the City at this time.
The City currently permits the consumption and sale of alcoholic beverages in
the Clifton C. Miller Community Center and in City parks under special
circumstances. Fees for alcoholic beverage permits are currently charged to
users of the Clifton C. Miller Community Center-but are not charged to users of
public parks. Permits for alcoholic beverages in public parks are reviewed and
approved by the Chief of Police'and City Manager, as well as the Director of
Community and Administrative Services.
Users of City facilities are not required to furnish liability coverage for
their activities at the present time. The Orange County Cities Risk Management
Agency offers a program of low cost liability insurance which provides $500,000
CSL of coverage to both the City and the facility user. This program includes
coverage for host alcoholic beverage liability, our largest source of exposure
at this time. The program is not difficult to administer and will benefit both
facility users and the City.
SUMMARY:
The recommendations listed above will be incorporated into the Community Service
Department's rental and reservation system. Coordination of the system would
remain the responsibility of the Community Services Department. Large groups
and special events of over 500 people would apply to the License and Permit
Board for their permits. The recommendations will be implemented with a series

of procedural changes to streamline the permit process and lead to the eventual
development of a master calendar system.

PUBLIC FA~ILITIES RESERVATION AND FEE POLICY
We are happy that you have scheduled the use of one of our facilities. A
member of our staff will be on the premises to admit you AT THE TIME YOU
SPECIFIED. Since that person is working on a schedule, you will have to
arrive at the time stated in your contract. Athletic and park areas are
accessible during daylight hours and do not require staff to admit you.
We ask that you take a few moments and read the following information in
order to understand what will be expected of you and/or your organization
as well as what you can expect of us. If you have any questions, please
call the Community Services office at 544-8890, extension 220.
A. GENERAL RULES
Facility-use agreements are issued in accordance with approved Coun-
cil policy. Reservation applications must be signed and returned
along with required deposits before consideration of use approval.
Facility-use applications and subsequent deposits must be handled in
person; we are unable to reserve a date for you by~ephone. SUB-
MISSION OF RESERVATION REQUEST DOES NOT CONSTITUTE APPROVAL.
1. . All applications for reservations must be on official forms
provided by the Community Services Department.
2. All groups are responsible for notifying the Community Services
Office of any change in their use of a facility, especially
cancelled dates. Cancellation fees are noted on the fee
schedule.
3. Permits will only be issued to persons 21 years and older. The
person signing the application must be present at the event.
I.D. may be required to determine either age or residency.
4. A chaperone may be required for every fifteen (15) youth under
age 18 at a dance or social function. Chaperones must be 21
years and older. A list of chaperones may be requested.
5. A clean-up deposit will be requi~ed from all groups prior to
building use. The facility must be cleaned up and returned to
reasonable condition. If the group fails to do so, the actual
cost will be deducted from the clean-up deposit. In order to
qualify for a full refund of all your deposits, please wipe up
the sinks, put away tables and chairs, trash, and restore the
facility to the condition in which it was found. Everything
must be accomplished prior to closing time as stated on the ap-
plication.
6. Any person or group causing property or equipment damage will be
required to pay for same (based on current cost of repair or
replacement). Until pa~q~ent is received, the City shall have
the right to cancel the group's current contract and reject fu-
ture applications.
7. NO NAILS, STAPLES, ET CETERA WILL BE PERMITTED ON THE WALLS,
CEILING, CARPETS, OR WINDOWS OF ANY FACILITY. All dec~
materials must be flame retardant, as required by law.

Groups requiring time to decorate or make other preparation must
include time on original permit. Each group is responsible for
setting up and putting away tables and chairs they utilize.
All food stuffs must be removed from kitchen upon conclusion of
event.
Buildings and grounds must be vacated no later than 1:00 a.m. on
Friday and Saturday evenings; usage Sunday through Thursday will
be no later than 11:00 p.m. Facilities cannot be used prior to
8:00 a.m.
Equipment (tables, chairs, etc.) may not be moved from facility
to facility, only those items normally located at the requested
facility may be used by the applicant. No storage space is
available for rental groups' equipment.
Alcoholic beverages are not'permitted in any building (City Code
6310) with the exception"~ir the Clifton C. Miller Community
Center upon approval. See section on alcoholic use information
below.
The City of Tustin does not accept any legal responsibility for
any act or incident arising from use of its property by any or-
ganization or group.
All fees are payable in full 30 days prior to use of the facil-
ity for building rentals. Ball diamond fees are due in full a
minimum of 3 days in advance of the first use.
Buildings are not available for rental or use on City holidays
or holiday eves (1/2 day holidays).

C. SPECIFICATIONS FOR GROUP #2 USERS
1. The organization must be registered as a non-profit corporation
with the State of California, or if not registered with the
State, must have a constitution or bylaws which clearly state
that the objectives of the organization are of a non-profit,
non-commercial nature.
2. The organization must be comprised of volunteers, 50% of which
must be Tustin residents.
3. The organization must submit the following:
- If incorporated, submit State incorporation papers and bylaws;
if not incorporated, submit constitution and bylaws.
A current financial statement. An additional financial
statement will be required on October 1 of each year.
- A signed statement verifying item #2 above, along with a copy
of a current roster.
4. Membership and meetings must be open to the public.
D. SPECIFICATIONS FOR GROUP #4 USERS
Group #4 users must meet all criteria for group #2 users, with the
exception of the residency requirement.
E. FEES AND DEPOSITS
Refer .to the current fee schedule.
F. ADVANCED RESERVATIONS
1. Reservations of facilities and payment of fees, when applicable,
must be made at least one week (5 working days) in advance of
the desired date to allow for processing time. All applications
for reservations of facilities shall be made on official forms
provided by the Tustin Community Services Department.
2. Use of the facilities shall be subject to control by the City of
Tustin Community Services Department. Reservations during the
week (Monday through Thursday) may be made up to ninety days in
advance of the activity for resident groups or persons and sixty
days in advance of the activity for non-residents. On weekends
(Friday, Saturday, and Sunday), reservations may be made up to
two hundred and seventy days in advance for residents and one
hundred and fifty days in advance for non-residents.
3. Reservations shall not imply or constitute propriety rights or
benefits for any group, organizations, or persons. Therefore
any continuous group application for meetings or activities in
City buildings shall be limited to four meetings per applica-
tion, no matter into what advance reservation category the group
falls.
4. Continuously-scheduled activities and events~conducted by organ-
izations or individuals in priority groups 4, 5, and 6 may be
pre-empted by any other higher priority group with a minimum of
two month's notification. (This clause applies only to contin-
uous requests, not one-time events.) The pre-empting group must
have paid all fees and deposits prior to the notification. In
the event that the pre-empting group cancels their activity, all
fees and deposits paid are non-refundable.
5. Athletic field dates may be reserved for a maximum of two days
at a time. Recognized tournament organizations may submit
requests for a maximum of one weekend per month in December for
the following calendar year. Non-profit youth sports
organizations shall coordinate their facility requests through
the Tustin Area Sports Council.
G. USE OF ALCOHOL
Application: Application to serve alcohol shall be made to the
Community Services o~fice, in writing, signed by the applicant if an
individual, or by a duly authorized agent thereof, if a club,
organization, or corporation, and shall contain the following state-
ments and information:
1. The name and address of the applicant in the case of an individ-
ual; in the case of a club, organization, or corporation, the
names and addresses of the officers and directors of the club,
organization or corporation;
2. The date and hours of the occupancy;
3. The type of function planned for said hours and date;
4. The number of persons expected to attend such function.
Said application must be made at the time the rental application is
made.
Restriction on application: Use of alcohol shall be approved for
persons who are of good character and reputation in the community in
which they reside.
Security may be required at events where alcoholic beverages
will be served. These services will be provided at the expense
of the facility applicant. Fees for security will be pa~ble to
the Community Services Department prior to the function. (See
"Security' below.)
Prohibited actiVities: The following activities are hereby prohib-.
ited in connection wi th the serving or selling of any alcoholic
beverages:
1. No alcohol or alcoholic beverages shall be served to minors.
2. All minors must be accompanied by a parent, adult, relative, or
legal guardian.
3. No leftover food or beverages shall be allowed to remain on the
premises.
Requirements: The following requirement shall be met and shall be
the responsibility of each person requesting use of alcohol. A
cleaning and damage deposit in an amount determined by the Director
of Community and Administrative Services shall be deposited by the
City.
H. SALE OF ALCOHOL
Proof of an alcoholic beverage control (ABC) license shall be
provided if ~cohol is to be sold during the scheduled
activity.

2. ABC Permit must be in the possession of the applicant throughout
the activity.
SECURITY
1.. As determined desirable by the City of Tustin, off-duty Tustin
Police officers may be required for security purposes. Said
Police officers shall then be under the complete direction and
control of the Tustin Police Department. Such users will make
arrangements through the Community Services Department.
2. The use of any building will NOT be granted to any organization
which is deemed detrimental to the public welfare by the Tustin
Police Department. Use agreements will be continued only with
organizations or persons who demonstrate responsibility.
J. INSURANCE REQUIREMENTS
All groups with reservations involving alcoholic beverages are
required to provide the City with a Certificate of Insurance naming
the City of Tustin as an additional insured. Policy limit is a
minimum of $500,000. combined single limits. The City of Tustin
offers liability insurance as an option to providing a Certificate of
Insurance. See the attached schedule for policy costs.
Athletic facility users are also required to furnish the City with a
Certificate of Insurance naming the City of Tustin as a coinsured.
The City of Tustin will provide quotes for liability insurance to
athletic groups on an individual basis upon requst.
K. SPECIAL PERMITS AND ADDITIONAL FEES
Large groups (over 500), sound amplification and alcoholic beverage
permits require special permits and additional fees. Plot plans/maps
must accompany applications for sound amplification and uses
involving tents, booths, bleachers, special equipment, or large
groups of people. Refer to current fee schedule.

All requests must be made on the FACILITY USE A~PLICATIOX and are subject to the
facility rental fee schedule as set forth by the City of Tustin. A deposit is
required to accompany the application· Submittal of said application and check does
not constitute rental until the application has been approved by the Director Of
Community and Administrative Services. The balance of fees are paYable in full 30
days prior to the event· The City reserves the right to cancel an event for
non-paj4nent of fees. Checks should be made payable to the CITY OF TUSTIH.
Valid identification will be requested upon application for building rentals to
verify residency and fees.
A refund of deposit, minus a $25 service charge, ~11 be given if a cancellation
occurs m~re than 30 days prior to the scheduled date. Cancellations within the 30
days prior to the event shall forfeit the deposit pa)merit. All refunds are subject
to a service charge.
The applicant signing the form takes full responsibility for loss or damage to the
property and the conduct of those using the facility. The applicant must be at least
21 years of age.
Alcohol beverages are NOT permitted in any building or on any City Park (City Code
6310) unless approval on an alcohol beverage use permit is obtained.
Each group is responsible for setting up the facility and for cleaning up and
restoring the facility to its original condition (replacing tables and chairs,
throwing out garbage, wiping up minor spills). All decorations, foods, and equipment
must be removed from the facility by the time designated on the application. The
City does not take responsibility for any items left in the facility.
The City shall provide normal use building maintenance; however, when extra
maintenance is required due to an abnormal condition caused by a specific group, the
refundable cleaning deposit wfll be surrendered to cover said maintenance and
damages. Groups will not be allowed continued use of any building until such fees
are submitted.
The City of Tustin does not accept any legal responsiblity for any act or incident
arising from use of its property by any organization or group.
As determined desirable by the City of Tustin, off-dutyTustin Police officers may be
required. Said Police officers shall then be under the complete direction and
control of the Police Department. Tw~ officers shall be required for groups up to
150 people; an additional officer will be required for each additional. 75 persons.
Fees for such security are the responsiblity of the applicant and will be paid for
prior to the event.
All decorative materials must be flame retardant as required by law and must be
removed following use. The use of nails, tacks, staples, et cetera is not permitted;
however, tape may be used.
The use of any facility will NOT be granted to any organization which is deemed
detrimental to the public wel a~e by the Tustin Police Department or the Tustin
Community Services Department. Use agreements will be continued only with
organizations or persons who. demonstrate responsibility.
No solicitation of donations or contributions or sale of anything of value for any
purpose shall be made on City property without prior consent, nor shall any City
property be used for purposes of personal gain. Exception: Activities which entail
a charge by applicant strictly for the purpose of supporting said event or program.
Charges of this nature are subject to the approval of the Director of Community and
Administrative Services.
Advance reservations may be limited to no more than four dates at any time. No more
than two dates for fields.
