Request for Interpretation of Extending Use Permit 81-22:
Far West Savings & Loan Association
DISCUSSION
The Planning Agency, on July 6, 1981, approved Use Permit 81-22,
authorizing the construction of a 60,000 square foot office building behind
the present Par West Savings and Loan structure'at 615 E. First Street.
The proposed height was limited to 72 feet (5 stories). Since the
applicant was unable to commence construction within the one-year time
limit required by Ordinance,. the applicant requested an extension of Use
Permit 81-22. The City Council, acting as the Planning Agency, authorized
the one-year extension, which is now due to expire on August 13, 1983.
Again, the applicant, Far West Savings and Loan, has submitted an extension
request since they are still unable to commence construction of the
approved building.
According to the Planning Agency minutes of May 17, 1982, Councilman
Saltarelli made a motion to approve the exension of Use Permit 81-22, "for
one year only, after which time it would be subject to re-application".
The motion was seconded by Councilman Edgar and approved by a vote of 5
ayes to zero noes. While staff has informed Far West Savings and Loan that
further extensions are not possible, they have exercised their right to
directly seek Council's opinion of Councilman Saltarelli's motion.
Copies of the applicant's request for extension, minutes of the Planning
Agency meeting of May 15, 1982, and previous reports are attached to this
transmittal for Council's consideration.

Far West has found that poor economic factors has made it impossible
for us to undertake our office project under Use Permit 81-22. We
would like to request an additional 1 year extension so that we can
finalize this building and get underway.

On May 17, 1982, the Tustin Planning Agency granted an extension
of Use Permit 81-22 for a period of one (1) year. The new
expiration date is August 13, 1983. The Agency did express a
desire to review the construction documents prior to issuance of
building permits. Please submit these documents at the earliest
possible date.

REC(~NDED ACTION
It is recommended that the Agency extend Use Permit 81-22 for a period of
one year. The extension may. be granted by Minute Order.
BACKGROUNO
On July 6, 1981, the Planning Agency adopted Resolution 1988 thereby
authorizing t~e construction of a 60,000 square foot office structure
behind the Far West Savings & Loan at 615 E. 1st Street. The maximum
height of the structure is to be seventy-two (72) feet.
Subsequently, an appeal of the Agency's action was heard and denied by the
City Council (Resolution No. 81-91).
DISCUSSION
The applicant has requested that Use Permit 81-22 be extended for a period
of one year. The new expiration date would be August 3, 1983, one year
from the date Council upheld the Agency's approval of the project.
Far West has recently undergone an administrative reorganization and feels
the additional time is necessary to complete the project as proposed.
