1983-84 LANDSCAPE MAINTENANCE PROGRAM
RECOMMENDATION:
Request the Tustin Community Redevelopment Agency reject all proposals received on
June 10, 1983 for the 1983-84 Landscape Maintenance Program and re -advertise for
same.
BACKGROUND:
Tfie Agency authorized the advertisement of the 1983-84 Landscape Maintenance
Program at their meeting of May 16, 1983. The advertisement and proposal opening
was conducted in accord with the approved schedule.
On June 9, 1983, this office was questioned as to the prevailing wage rate for
landscape maintenance, which is required in the specification. The inquiries were
made because contractors were being quoted different wage rates when contacting
various State offices. Staff subsequently contacted these offices and.obtained
the same inconsistent information. (A court decision of two weeks ago was
attributed as the cause for the inconsistency.) Because of this irregularity, it
is felt that all quotations received should be rejected and the project should be
re -advertised.
This office has applied to the Department of Industrial Relations in San Francisco
for an official written determination of the prevailing wage rate for the Tustin
program. Should the Agency decide to re -advertise this project, written
determination from the State should be received by June 20, 1983.

If this recommendation is acceptable to the Agency, a complimentary set of
specifications and proposals will be mailed to all contractors who previously
purchased the package.
If the recommendation is not the pleasure of the Agency, staff would recommend the
contract be awarded to Environmental Care, Inc. for $7,500.

3 SPECIFICATIONS FOR THE CITY OF TUSTIN FISCAL YEAR 1983-84
LANDSCAPE MAINTENANCE PROGRAM AND DIRECTING THE SECRETARY TO
4 ADVERTISE FOR BIDS

7 WHEREAS, it is the intention of the Redevelopment Agency of the City of
Tustin, California to contract the landscape maintenance in the E1 Camino
8
Real/Main Street area, and;
9 WHEREAS, the City Engineer has presented plans and specifications for
10 said work;
NOW THEREFORE, BE IT RESOLVED that the plans and specifications
11 presented by the City Engineer be and are hereby approved as the plans and
12 specifications for:

14 BE IT FURTHER RESOLVED that the Secretary is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or

specifications which said advertisement shall be substantially in the
16
following words and figures to -wit:

1 The foregoing is being given as a basis for the comparison of bids, and
the Tustin Community Redevelopment Agency does not, expressly or by
2 implication, agree that the actual amount of work will correspond
therewith, but reserves the right to increase or decrease the amount of
3
any class or portion of the work or to omit portions of the work as may be
4 deemed necessary or advisable by the Engineer.
The Tustin Community Redevelopment Agency has budgeted a fixed amount
5 for the work encompassed by these plans and specifications. In the event
that the low bid exceeds or is less than the budgeted amount, the Agency
6 reserves the right to delete or add projects to the contract as necessary
to stay within the budgeted amount. The provisions of Section 4-103B of
7 the Standard Specifications (increased or decreased quantities) shall not
8 apply to this contract.
Plans, specifications and proposal forms to be used for bidding on this
9
project can only be obtained by prospective bidders at the office of the
Agency Secretary, Tustin City Hall, 300 Centennial Way, Tustin,
10
California, 92680, upon payment of $5.00 per set, which amount shall be
non-refundable.

12 Plans and specifications will only be mailed out upon payment of
13 $10.00 per set, which amount shall be non-refundable.
In conformance with Section 37931 of the Government Code, all bids
14 shall be presented under sealed cover on the proposal form provided and
15 accompanied by one of the following forms of bidder's security:
a. Cash
16 b. Cashier's check made payable to the Tustin Community
Redevelopment Agency.
17 c. Certified check made payable to the Tustin Community
Redevelopment Agency.

d. Bidder's bond executed by an accredited surety insurer, made
19 payable to the Tustin Community Redevelopment Agency.
The security shall be in an amount equal to at least ten percent
20
(10%) of the amount of the bid. A bid shall not be considered unless one
21 of the forms of bidder's security is enclosed therewith.
A Security Bond for payment of labor and materials will be required
22 in the amount of fifty percent (50%) of the estimated total contract price
and a Faithful Performance Bond in the amount of one hundred percent
23
(100%) of the estimated total contract price in the form attached to the
24 contract documents. Said bonds shall be issued by a Surety Company rated
Grade A or better and Class IX or better by the latest edition of Best's
25 Key Rating Guide.
The Tustin Community Redevelopment Agency reserves the right to
26
reject any or all bids, and/or waive any informality on a bid. No bidder
may withdraw his bid for a period of thirty (30) days after the date set
27
for the opening thereof.
28 The contract will be awarded to the lowest qualified bidder.

1 Provisions of the State Contract Act are not applicable, and
2 prospective bidders will not be required to be prequalified.
All work to be done under the direct supervision of the Maintenance
3 Superintendent, City of Tustin.
4 All work to be paid for at the prices bid from appropriated monies.
5 The Tustin Community Redevelopment Agency has obtained from the Director
of Industrial Relations the general prevailing rate of per diem wages and
6 the general prevailing rate for legal holiday and overtime work in the
locality in which the work is to be performed for each craft or type o

work needed and a copy of the same is on file in the office of the Agency
8 Secretary.
9 Not less than said prevailing rates shall be paid to workers employed on
this public works contract as required by Labor Code Sections 1771 and 1774
10 of the State of California.

The work to be done and referred to herein is in the City of Tustin,
California, and is to be constructed in accordance with the specifications and
contract annexed hereto and also in accordance with the Standard Specifications
of the State of California, Business and Transportation Agency, Department of

The undersigned understands that the foregoing is being given as a basis for the
comparison of bids and the Tustin Community.Redevelopment Agency does not, expressly
or by implication, agree that the actual amount of work will correspond therewith, but
reserves the right to increase or decrease the amount of any class or portion of the
work, or to omit portions of the work as may be deemed necessary or advisable and in
the best interests of the Agency by the Tustin City Engineer.
If this proposal shall be accepted and the undersigned shall fail to contract as
aforesaid and to give the two bonds in the amounts to be determined as aforesaid, with
surety satisfactory to the Tustin Community Redevelopment Agency, within ten days, not
including Sundays and legal holidays, after the bidder has received notice from the
Tustin City Clerk that the contract has been awarded, the Tustin Community
Redevelopment Agency, may, at its option, determine that the bidder has abandoned the
contract, and thereupon this proposal and the acceptance thereof shall be null and
void, and the forfeiture of such security accompanying this proposal shall operate and
the same shall be the property of the Tustin Community Redevelopment Agency.
