NO. 53 06-06-83 · m ~ 6-6-83 Inter-Corn June 1, 1983 ~,~~j TO: HONORABLE MAYOR AND CITY COUNCIL FROM: BILL HUSTON, CITY MANAGER SUBJECT: REORGANIZATION NO. 53 It is reconmended that the City Council adopt the attached resolution which sets November 8, 1983 aS the date for an election regarding Reorganization No. 53. Pursuant to State law, an election is required since at least 25% of the registered, voters within the affected area filed written protests. Only registered voters residing within the area of Reorganization No. 53 at the time of the election will be permitted to vote on whether the boundary adjustment should-proceed. BH:dmt 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 83-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING THE VALUE OF WRITTEN PROTESTS AND ORDERI!NG REORGANIZATION NO. 53 AND TRANSFER OF TERRITORY BETWEEN THE CITIES OF IRVINE AND TUSTIN, SUBJECT TO THE CONFIEMAT!ON BY THE VOTERS. The City Council :of the City of Tustin does hereby resolve as follows: Pursuant to Part 2 of Title 4, Division 2, commencing with Section 35200 et. seq. of the Government Code, preliminary proceedings were completed by the Local Agency Formation Commission on January 26, 1983, and by LAFCO Resoliution No. 83-4 the City of Tustin was designated the conduct- ing authority and authorized to proceed with the transfer of territory between the cities of Irvtne and Tustin designated "Orange County (Muni- cipal) Reorganization No. 53." II. The Tustin City Council, pursuant to Section 35300 of the Government Code adopted Resolution No. 83-10 initiating reorganization proceedings and scheduling a public hearing for March 21, 1983, at 7:30 p.m. III. Due notice:was given and a protest hearing was conducted at the adver- tised timeland place. Protests filed by 0 property owner(s) repre- senting 0% of the total assessed value of a~-~-d and 49 protests filed by registere--~ivoter~ representing 37.4% of the registered voters within the area proposed for reorganization were received prior to the close of the hearing. IV. The City C~uncil hereby orders Reorganization No. 53 and transfer of territory between the Cities of Irvine and Tustin subject to the confir- mation by ~he voters residing within the affected territory. Ve The City Clerk shall schedule said matter at the next regular election to be held on November 8, 1983, 'and shall cause notice of the election to be given as prescribed in Section 35055 of the Government Code, and an election to be conducted as prescribed by Chapter 1, Article 4, Sec- tion 35060 et. seq. of the Municipal Organization Act of 1977.
