SUBJECT: PRIVATE ALLEY BETWEEN PROSPECT AVE. AND PREBLE DRIVE
AND NORTHERLY OF THIRD ST. (REPORT)
BACKGROUND:
At a previous meeting, City Council requested additional information from staff
regarding the cost of repairs of the subject alley and any legal precedents that
may be set by this repair.
The previous staff report dated 4-15-83 is also attached for your information.
DISCUSSION:
A cost estimate for the repair of this alley consisting of the excavation and
replacement of the deteriorated pavement and a 1" thick overlay over the entire
alley is $6,000.00. This provides only minimal work to provide, for a satisfactory
riding surface.
The City Attorney's-office has reviewed the'following:

Legality of expending public funds on private streets, alleys or
driveways.
Future liability to the City in the event City makes initial repairs
and the streets, alleys or. driveways are not adequately maintained
in the future.
Could the repair of this alley set a precedent for the City to be
responsible to repair other similar private facilities.
The Attorney's office indicated that it would be difficult for either the City or
R.D.A. to justify the use of public funds for the maintenance or repair of private
property. They also indicated that the City could be liable for any future
hazardous conditions that were not promptly and adequately repaired by the private
property owners.
The repair of this alley could also set a precedent for the City to repair other
private facilities if requested, which could impose a financial burden to the
community.
