HomeMy WebLinkAboutCC MINUTES 1951 09 17296 MINUTES OF A MEETING OF THE CITY COUNCIL OF TUSTIN, CALIFORNIA, HELD ON MONDAY EVENING, SEPTEMBER 17, 1951, AT 7:30 P.M., AT THE CITY HALL COUNCILMEN PRESENT: Vincent L. Humeston, William I. Miller, William H. Gray and Frank E. Bacon, Jr. COUNCILMEN ABSENT: J. Roy Teter. CITY ATTORNEY: C. Arthur Nisson, Jr., was present. The meeting was called to order by Mayor Humeston at 7:30 P- M. Minutes of the previous meeting were read and approved. WILLIAM V. Mayor Humeston brought up the matter of the employment FLETCHER PAID of William V. Fletcher, by parties by parties unkown, as a Swim- $130.00 FOR ming Instructor during the Summer Recreation Program SERVICES DURING at the Tustin Union High School. Councilman Gray moved SUMMER RECREA- to rescind the motion of June 4, 1951, indicating the TION PROGRAM Council's willingness to donate up to $150.00 for the Summer Recreation Program in the event of a deficit and in its place to authorize the payment to William V. Fletcher of $130.00 for his services as Swimming Instructor which will complete any obligation of the City to the 1951 Summer Recreation Program. Seconded by Councilman Bacon the motion duly carried. The matter of Mr. O. V. Dart's erection of a small office building on skids on his property at 650 W. First St., was brought up by Mayor Humeston. Build- ing Inspector Broomell was present and stated his views on the matter. City Attorney Nisson presented the legal aspects of t he matter and recommended filing an Injunction Suit and limiting Mr. Dart's activities to his previous use of the property. On motion of Councilman Gray, seconded by Councilman Miller and duly carried, Attorney Nisson was in- structed to contact Mr. Dart, or his Attorney, and endeavor to get Mr. Dart to conform to the previous use of the property in accordance with the provis- ions of Ordinance 71. Such action to include a Suit of Injunction if necessary in the opinion of the City Attorney. On motion of Councilman Miller, seconded by Council- man Gray and duly carried, the City Clerk was in- structed to refuse to issue a Business License to an applicant in the matter of the Dart property at 650 W. First Street and Building Inspector Broomell was instructed to refuse occupance and utility con- nections for any improvements on this property. The matter of Mr. George M. Sandstrom's proposed 16-unit Tourist Court, on "C" Street below First Street, was brought up and after discussion by the Council the City Clerk was instructed to refer the matter to City Attorney Nisson for further action. RESOLUTION NO. On motion of Councilman Bacon, seconded by Council- 295 ADOPTED man Miller and duly carried, Resolution No. 295 en- titled "A Resolution of the City Council of the City of Tustin Appointing the Mayor and Presiding Officer of the City Council of said City as a Member of the Board of Directors of County Sanitation District No. 7 of Orange County, and Appointing a Member of the City Council to Act as Such Member of said Board of Directors as an Alternate Director, to Act for and 297, In the Place and Stead of the Mayor during his Absence, Inability or Refusal to Act" was adopted. MILLER APPOINTED Councilman Bacon and Councilman Miller were each nomin- ALTERNATE ated as Alternate Director. Councilman Miller was ap- DIRECTOR pointed to the position on motion of Councilman Gray, seconded by Councilman Bacon and carried. Councilman Miller reported that City Engineer McBride had stated to him that he will be present when the Tustin Water Works lays pipe lines at Lockwood Park Place in order to protect the City's interests. Councilman Miiler stated that if 'the property owners in the vicinity of Main and Myrtle Streets will cut down and dig out the roots of a dead walnut tree the City will haul it away in accordance with Ordinance No. 81. RESOLUTION Councilman Miller called attention to the lack of a N0. 296 "Stop Sign" at Main and California Streets and moved ADOPTED that Resolution No. 296 entitled "A Resolution of the City of Tustin Authorizing the Placing of a Boule- vard Stop at California Street where it intersects Main Street" be adopted. Seconded by Councilman Gray the motion duly carried. On motion of Councilman Miller, City Attorney Nisson was instructed to prepare a Resolution regulating the load limit on certain City streets in the City of Tustin. Seconded by Councilman Bacon the motion car- ried. Councilman Gray requested to know the attitude of the Council in regard to the Court Reorganization and in- quired if the Council would be willing to authorize him to attend a meeting of the Justice and Constables Association with the Board of Supervisors to be held in the near future. On motion of Councilman Miller, seconded by Councilman Bacon and duly carried, Coun- cilman Gray was authorized to attend the meeting and present Resolution No. 28 and the necessary facts to support it.
