It is recommended that the 50 square foot reader board sign be approved by
Sign Code Exception by minute order.

As a result of the approval of the officq development to be constructed on
the north east corner of Holt and Irvine, arrangements had to be made to
relocate the Town & Country Flower Shop. The resolution of this matter was
a major concern of the Council throughout the entire history of the
project.
Through negotiations between Burnett-Ehline and the flower shop owner, the
shop has been moved to 18352 Irvine Boulevard, a small retail center
immediately to the east of the previous location.
The shop owner agreed to move to this new location only if she could
maintain signage comparable with that utilized at her old shop. The sign
plan submitted is satisfactory to the owner. The signs requested are not
completely within the purview of the Sign Ordinance and therefore under
Article VII, Section 1, the Council is requested to consider a Sign Code
Exception. Briefly that section states:
The City Council may grant authorization for signs which are not within the
purview of the standards and criteria established by this Ordinance, due to
unusual circumstances related to the development, activity, or location of
the proposed signing, subject to any of the following criteria:

Subject property is developed with structural setback more than two
times the minimum front setback requirement of the district.
Subject property frontage is at least 75% of the minimum frontage
requirements for like signing.
Proposed signing does not exceed more than one in number nor more
than 15% in area of the aggregate size of signs authorized by the
criteria of the district.
DISCUSSION
This department has received a sign plan for the new flower shop requesting
two wall signs. One, a 45 square foot tennant identification sign on the
store front, and the other a 50 square foot reader board on the rear of the
building.
Per Sign Ordinance 684, the flower shop would be allowed one 75 square foot
sign for the front wall and one 25 square foot side wall sign totalling 100
square feet of aggregate sign area. The store owner is requesting a Sign
Code Exception to install a reader board sign that is in excess of the 25
square feet normally permitted.
The request before the Council falls within the criteria for a Sign Code
Exception. The applicant is requesting less than the aggregate area than
would otherwise be allowed, and also meets criteria number two above.
It is recommended that the signs as submitted be approved based on the
following findings and conditions:
That due to the unusual circumstances of the development involving the
relocation of the shop to allow redevelopment of the Burnett-Ehline
property, and since the site has a property frontage of at least 75% of
the minimum requirement as required in Article VII of the Sign Code, a
Sign Code Exception is warranted.
That the request is for less than the aggregate sign area than would be
permitted so that no grant of special privilege would be given should
the exception be approved.
That no additional signing shall be permitted for the shop with the
exception of a 5 square foot window sign if one is desired. All other
advertising for sales, special events etc. should be accomplised by use
of the reader board, and not by temporary window signs or banners.

Gentlemen:
This letter is sent to explain events that took place during our effort to
relocate above-referenced business and obtain satisfactory signage for same.
As you may know, BUrnett-Ehline Company is presently developing the southeast
corner of Holt & Irvine. All of said property falls within the Tustin rede-
velopment area. In our discussions with the previous Director of Planning,
we were always encouraged to privately reach an equitable solution for relo-
cating the flower shop and not involve the redevelopment agency. Reasons for
working out privately would be a cost savings to the city and a time savings
to us as developers.
In negotiating with the owner of the flower shop to relocate to the adjacent
property, signage became a very important issue.
On March 4, 1982, a meeting with the previous Director of Planning was held
to discuss plans and sign rights. We discussed relocating an existing pole
sign and mounting to the front of the building and installing a reader panel
at the rear of the building. In an effort of cooperation the city agreed
that where normally 2 signs would be allowed (one 25 sq. ft. and one 72 sq. ft.)
a concession would be made to allow installation of 2 signs in any combination
of 97 sq. ft.

Sign location and size was identified on the working drawings and submitted to
the city for permit. It is my understanding that the sign permit was applied
for but the subcontractor was short some paper work and inadvertently overlooked
going back to pull the actual permit. I hereby request that the sign permit be
issued.
