AND PREBLE DRIVE AND NORTHERLY OF THIRD ST. (REPORT) BACKGROUND: At a recent City Council meeting, the Council expressed a concern about the pavement condition of a private alley located northerly of Third St. and between Preble Dr. and Prospect Ave. This alley, which is delineated in green on the attached sketch, is a private driveway for the 5 lots fronting on Preble Dr. and Third St. The portions of public alley are delineated in yellow on the attached map, This private driveway is frequently used by the public and, consequently, experiences heavy pavement damage during the rainy season. It appears that some of the property owners have recently attempted to reduce the severity of the holes by fill'ing them with 9ravel. DISCUSS[ON: Staff feels that if any pavement repair work is performed on this driveway by the City, that a precedent could be established that may require the City be responsible for maintenance of all private driveways/alleys. In lieu of performing any pavement rehabilitation work on this driveway, it is suggested that signs be posted at Location A and Location B as shown on the attached sketch and as follows: PRIVATE DRIVEWAY DO NOT ENTER In the event the Council is desirous of maintaining this driveway, it is suggested that all of the driveways/alleys throughout the City be evaluated and a cost impact of same be prepared. Gentlemen: The Council ia to be congratulated on the major renovations to the doentown area that have been achieved during the past year. I think it is no~ time to look around us st some of the smeller items that detract from excellence end do ~het we can ~o correct them. One such situation that has plagueddman¥ o? us for the past three years or more is the condition of the ailsv that leads south from the past office and ends et Third St. The monumental chuck-holes near its south end have to be seen to be believed. In the name of good house- keeping and basic safety the mass cries out for repair° I have been informed that the alley is on private property belonging ~o the apartment complex lying to the east. Inasmuch ss passage has been open to the public since the com~iex ess built, I am sure that such passage cannot be closed off. I am equally sure that if the city has the legal right to force a !ando~ner to remove unsightly seeds from a vacant lot it can find lawful muscle sufficient to brin9 about the ~orrection of this 9odaeful mess.
