A summary of past actions concerning land use is as follows: Oc~ber 20, 1982 - Resulting from a request from the property owner for a land use reclassification for the apartment complex at 18112-18138 Main Street as well as the World Service Station from the present Multiple- Family designation to Commercial, the issue was brought before the Planning Agency. In reviewing the appropriateness of the request, staff was of the opinion that not only a redesignation of the Main Street property was a reasonable and desirable action, but in addition, several other properties in the immediate area should be changed to promote more suitable development potential. The Planning Agency agreed and directed staff to initiate proceedings for the necessary General Plan Amendment. February 28, 1983 - After the appropriate public hearing, the Planning Commission adopted Resolution No. 2078 recommending to the Council that GPA 83-1(A) be approved. March 7, 1983 - The City Council adopted Resolution No. 83-18 which amended the Land Use Element to reflect a change from Multiple-Family Residential to Commercial. April 11, 1983 - The Planning Commission adopted Resolution No. 2087 which recommended approval of this zone change to the City Council. DISCUSSION The project before you is to bring the zoning into conformance with the Tustin Area General Plan. The present zoning is Multiple-Family Residential (R2 & R4) and the proposed zoning is Commercial General-Planned Unit Development (CG-PUD). Not only would this designation reflect the highest and best use of the property, but the PUD concept will provide assurance that the design plans will require a public hearing before the Planning Commission. Mayor & City Council April 18, 1983 Page 2 CONCLUSIONS 1. That because of the nature of the surrounding areas and because the properties are near Newport Avenue, the proposed zoning designations are more appropriate. 2. The CG-PUD designation dictates that any change to the property requires that a use permit be considered at a public hearing before the Planning Commission. 3. This change will bring the zoning into conformance with the Tustin Area General Plan. RECOFg~NDED ACTION M.O. - That Ordinance 886 have first reading by title only. The City Council finds and determines as follows: A. That a proper application, (Zone Change 83-1), has been filed by the City of Tustin, for a zone change from Multiple-Family Residential (R2 & R4) District to Commercial General-Planned Unit Development {CG-PUD) District for the property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. B. That a public hearing was duly called, noticed and held on said application. C. That a zone change should be granted for the follow- ing reasons: The Commercial General District is in conformance with the commerical land use designation of Tustin Area General Plan. The Commercial General District authorizes a broader range of permitted uses and provides the opportunity for review of unclassified uses for appropriateness of site and development. D. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. E..Final development plans shall require the review and approval of the Community Development Director. F. That a Negative Declaration was previously approved to comply with the requirements of the California Environmental Quality Act. G. The City Council hereby approves Zone Change 83-1 for the above described properties (Exhibit "A") from Multiple-Family Residential (R2 & R4) District to Commercial General-Planned Unit Development (CG-PUD) District.
