BACKGROUND
On October 4, 1982, the City Council adopted Resolution 82-81 ordering the
annexation of certain properties within Tustin's sphere of influence
including the subject property (Annexation 130). On October 14,~1982, the
certificate of completion was filed by the Local Agency Formation
Commission finalizing the annexation. The zone designation for the
property, while under County jurisdiction, was Single-Family (R-l) in
compliance with the Tustin General Plan. Therefore, no pre-zone
proceedings were necessary.
On February 28, 1983, the Planning Commission considered General Plan
Amendment 83-1(B) which included one of the two lots located at what is
commonly known as 1252 Irvine Boulevard. At that meeting, there was some
discussion concerning the inclusion of the undeveloped lot immediately to
the east of the parcel with the old Spanish-style house. Because of notice
requirements, only one lot was considered.
On March 7, 1983, the City Council referred the item back to the Commission
for inclusion of the second parcel. A second public hearing before the
Planning Commission was advertised and held resulting in a recommendation
to amend the General Plan and change the land use designation for both
parcels {103-626-26 and 27) from Residential to Professional.
On April 4, 1983, the City Council adopted Resolution 83-19 which approved
this amendment to the land use element for these two properties.
On April 11, 1983, the Planning Commission adopted Resolution no. 2086
which recon~ended approval of this zone change to the City Council.

DISCUSSION
The action before you is to change the zone from R-1 (Single-Family
Residential) to PC-PR (Planned Community-Professional Office). One
developer has indicated a desire to improve and convert the existing
Spanish home into an architect's office. Considering the surrounding uses
that front on Irvine Boulevard, the request appears to be a justifiable
transition between the single-family uses and commerical uses (Tustin
Heights Shopping Center). To ensure that adjacent homeowners are not
adversely impacted by potential office development, the Planned Community
Designation requires that a use permit be considered at a public hearing
prior to the issuance of a development permit.
CONCLUSIONS
1. That because of the nature of the surrounding uses, and because the
property fronts on Irvine Boulevard, a professional zoning designation
is justifiable and more appropriate than single-family residential.
2. That professional offices have been traditional buffers between
residential and commercial uses.
That a proposed development includes keeping intact an existing
structure with architectural style condusive to the area, as well as
maintaining several of the mature trees on-site.
4. The Planned Community-Professional zoning classification dictates that
any change to the property requires a public hearing and use permit.
5. This zone change will bring the zoning into conformance with the Tustin
Area General Plan.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, APPROVING THE RE-ZONING
OF THE PROPERTIES LOCATED AT 1252 IRVINE
BOULEVARD (AND ADJACENT UNDEVELOPED PARCEL)
FROM SINGLE-FAMILY RESIDENTIAL (R-l) DISTRICT
PLANNED COMMUNITY PROFESSIONAL (PC-PR) DISTRICT
The City Council of the City of Tustin does hereby ordain as
follows:
I. The City Council finds and determines as follows:
A. That a proper application, (Zone Change 83-2), has
been filed by the City of Tustin, for a zone change from
Single-Family Residential (R-l) District to Planned
Community-Professional {PC-PR) District for the property
described in Exhibit "A" attached hereto and
incorporated herein by this reference as though set
forth herein in full.
B..That a public hearing was duly called, noticed and
held on said application.
C. That a zone change should be granted for the follow-
ing reasons:
The Planned Community Professional (PC-PR) District
is in conformance with the commerical land use
designation of Tustin Area General Plan.
2. That professional offices have been traditional
buffers between residential and commercial uses.
That a proposed development includes keeping intact
an existing structure with architectural style
compatible to the area, as well as maintaining
several of the mature trees on-site.
D. Development of subject property shall be in
accordance with the policies adopted by the City
Council; Uniform Building Codes as administered by the
Building Official; Fire Code as administered by the
Orange County Fire Marshal; and street improvement
requirements as administered by the City Engineer.
E. Final development plans shall require the review and
approval of the Community Development Director.
F. That a Negative Declaration was previously approved
to comply with the requirements of the California
Environmental Quality Act.
G. Uses within the District are subject to approval of a
Use Permit

II.
The City Council hereby approves Zone Change 83-2 for
the above described properties (Exhibit "A") from
Single-Family Residential (R-l) District to Planned
Community Professional (PC-PR).
PASSED AND ADOPTED at a regular meeting of the City Council held on
the day of , 1983.
