HomeMy WebLinkAboutCC 8 SO COAST AIR BASIN 3-21-83DATE: MARCH 16, 1983 CONSENT CALENDAR No. 8 3-21-83 ln e,,-Con, FROH: S UBJ ECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS~CITY ENGINEER SANCTIONS TO THE SOUTH COAST AIR BASIN RECOH~ENDATION: That the Tustin City Council, at their meeting of March 21, 1983, pass and adopt the attached resolution opposing the Imposition of Sanctions by the Administrator of the Environmental Protection Agency upon the South Coast Air Basin and authorize the Mayor to send same to the Administrator of the Environmental Protection Agency. BACKGROUND: At their recent meeting, the City Council requested staff to respond to the United Environmsntal Protection Agency (E.P.A.) proposed rule-making notice disapproving the South Coast Air Basin's 1982 Nonattainment Area Plans for ozone and carbon · monoxide and the proposed moratorium on the construction of major new or modified stationary sources in the South Coast Air Basin. This notice would alwo solicit comments oh the withholding of federal funds for highways waste water ~reatment facilities and air grants in the South Coast Air Basin. DISCUSSION: The imposition of these sanctions will have a great impact on the South Coast Air' Basin in that a moratorium on major source construction would ban any new industrial construction or modification of an existing source if they emit 100 tons or more a year of any non-attainment pollutant.. Essentially, this would mean a ban on growth of basic industry in the basin. Additionally, the withholding of federal funding for public works projects would mean the loss of hundreds of millions of dollars into the basin as well as a freeze on facilities to accomodate any growth in population and would greatly impact the economy of the area within the South Coast Air Basin. Attached is a resolution that opposes the imposition of Sanctions by the Administrator of the Environmental Protection Agency upon the South Coast Air Basin which is submitted for adoption by the Tustin City Council. A/~o attached is a transmittal letter to the E.P.A. outlining two important concerns within the said resolution for the Mayor's signature. 'BB~LEDENDECKER DIRECTOR OF PUBLIC WORKS/ CITY ENGINEER db Attachments RESOLUTION NO. 83-26 1 2 3 4 5 A RESOLUTION OF THE CITY COUNCIL OF TUSTIN, CALIFORNIA OPPOSING THE IMPOSITION OF SANCTIONS BY THE ADF~rHISTRATOR OF THE ENVIRONMENTAL PROTECTION AGENCY UPON THE SOUTH COAST AIR BASIN WHEREAS, the City of Tustin is located within the South Coast Air Easin; and WHEREAS, the South Coast Air Basin stands to lose federal funds for 7 transportation improvements, sewage treatment facilities, air quality 8 planning and highway repair and construction if monetary sanctions are 9 imposed by the A~m~nistrator of the Environmental Protection Agency; and 10 WHEREAS, the South Coast Air Basin, already hard hit by unemployment, 11 stands to lose more jobs if a construction ban on new or modified major stationary sources is imposed by the Administrator of the Environmental Protection Agency; and WHEREAS, the imposition or'such sanctions would be counterproductive and could lead to worsened air quality and water quality; and WHEREAS, the imposition of such sanctions is not warranted because of the efforts of the South Coast Air Quality Management District and the Southern California Association of Governments who submitted a jointly prepared air quality management plan revision which met all Clean Air Act and 20 Environmental Protection Agency polic~ requirements and which has been praised as one of the best in the country; NOW, THEREFORE, BE IT RESOLVED that the City of Tustin opposes the imposition of sanctions by the Administrator of the Environmental Protection Agenc,~ upon the South Coast Air Basin and urges the Administrator to approve the air quality management plan revision submitted in 1982 so that progress toward cleaning up the air in the South Coast Air Easin can continue forthwith. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 21 22 23 25 26 0,7 28 PASSED AND ADOPTED by the City Council of the City of Tustin, California, this 21st day of March, 1983. The Tustin commanity, feels that any ~anctions imposed at this time will be counterproductive in 'that they will most likely worsen the air' quali, t~ of the basin. The current nonattais,~ut area plan which has been submitted to the EPA by the South Coast AQ~D Board is the most comprehensive, technically Sophisticated, and stringent in the country. The implementation of this plan assures that every reasonable measure to reduce emissions and attain air quality standards will be met at the earliest possible date. In order to avoid any additional economic threat to our area, it is again requested that the Administrator of the E.P.A. not impose any sanctions upon the South Coast Air Bamin.
