DATE: FROH: SUBJECT: February 14, 1983 PUBliC HEARING NO. 1 Inter-Corn Honorable Chairman & Planning Commission Members Community Development Department Variance 83-4 Applicant: Location: Request: Heath & Company on behalf of Ralph's Grocery Company 1114 Irvine Boulevard, Tustin Heights Shopping Center Authorization to vary with the sign code (Ordinance 684) provision for wall signs BACKGROUND On October 5, 1981, Use Permit 81-28 was approved by the Planning Agency which authorized the revitalization of the Tustin Heights Center. One of the major items was the approval of a revised master sign plan for all wall signs. The two {2) proposed signs would be in conformance with the approved master sign plan. At the time of approval, of the revised master sign'plan, staff pointed out that the existing center pole sign did not conform to City code. {The center was built in the'County.)It was' suggested then that "...at such time that a major expansion or modification is initiated by a major tenant, the center sign be brought into conformance with the Tustin Sign Code". At this time, none of the major tenants want to lose their c~nter identification signs or modify them and thus the inclusion of condition IID in Resolution No. 2077: "The existing pole sign for center identification shall be modified to include pole covers and sign cabinets to match the existing master sign plan." OlSCUSSION The applicant is requesting two {2) front wall signs of approximately 75 square feet each. Under the sign code provisions, the store would be allowed one (1) sign which could be 15% of the front wall area not to exceed 75 square feet. Since the size of the building is 39,000 square feet and the area of the front wall is 5,500 square feet, the sign areas would be only 2.7% of the front wall area. On January 3, 1983, the Planning Agency approved a variance for the proposed Marshall's in E1 Camino Plaza for the same reason. Their store front was 4,228 square feet and the size of the sign was 115 square feet which also covered 2.7% of the front wall area. Chairman & Planning Commission February 14~ 1983 Page 2 Enclosed in this report are the justifications for the second 75 square foot sign which was submitted by the applicant. FINDINGS 1; The front wall sign will cover only 2.7% of the front wall area in comparison to smaller stores which are allowed 15% of the area. 2. No other front wall signs will be allowed. 3. The new signs will match the recently approved master sign plan for the Tustin Heights Shopping Center. RECO~iENDED ACTION Approve Variance 83-4 by the adoption of Resolution No. 2077. MAC:ih Variance case ~ f3--~ Ralphs Grocery Company 1112-1134 Irvine Boulevard Tustin, California JUSTIFICATION Ralphs is the largest single Tenant in the Tustin Heights Shopping Center which contains more than 12 acres of land. The building contains more than 39,7S0 sq.ft, just for Ralphs. In the event that the building split and was leased to several smaller tenants, each smaller tenant would require his own sign, resulting in a much greater sign area than is being requested in this application. Ralphs is set back an average distance of 332 feet from Irvine Boulevard with several obstructions by other buildings, trees and shrubs. Therefore, the requested signage is necessary to provide reasonable visibility and identification. Granting the variance will not be injurious to the public welfare, nor to properties in the vicinity for they will not in any way detract from or lessen the value of adjacent properties. No hazard will be created due to fire, collapse, decay or abandonment. The sign will not obstruct fire fight- ing nor police surveillance. Pedestrian and vehicular traffic will not be impeded. No residences will see these signs. The signs will be in harmony with the general plan. The new Ralphs will have two main entrances. The signs will indicate to the public that both entrances may be used. We Originally proposed four signs on the north elevation. As a compromise, we are now asking for two main identification signs on the building, so as to reach out to the general public in the vicinity, and to better identify our- selves. Others in the immediate vicinity now enjoy such a privilege as having signage that exceeds the limitation. (Mercury Savings across the street from the site, Tustin Lanes having an off site sign, and Mervyns, having two large signs on their building in the center to our west). Approval of these signs will greatly aid not only the property owner and Ralphs, but your city as well, through the realization of greater revenues through tax- ation. 10. The proposed signage represents closer conformance to codes than did the signage utilized by the prior tenants in the space, Guild Drug and Nahas Department Store. We look forward to the opening of our new Ralphs Supermarket. The new store will be bigger .and better than our old store at the Tustin Heights Shopping Center. Ralphs has been a great asset to the City of Tustin. Our new store will be of tremendous value to the community. The Planning Commission finds and determines as follows: A. That a proper application, (Variance No. 83-4), was filed by Heath & Company on behalf of Ralph's Grocery Company requesting authorization to vary with the requirements of Sign Ordinance No. 684 to permit a two (2) front wall signs of 75 square feet. B. That a public hearing was duly called, noticed and held on said application. C. That because of special circumstances applicable to the subject property, relative to size, shape, topo- graphy, location or surroundings, a strict application of the Zoning Ordinance is found to deprive subject property of privileges enjoyed.by other properties in the vicinity and under identical zone classification, evidenced by the following findings: 1. The use is in conformance with the land use element of the Tustin Area General Plan. 2. The large size of the building warrants wall signs to be proportionately compatible. 3. The front setback of Ralph's is 332 feet. D. That the granting of a variance as herein provided will not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated. E. That this project is categorically exempt from the requirements of the California Environmental Quality Act. F. Proposed development shall be in accordance with the development policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Codes as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. H. Final sign plans shall require the review and approval of the Community Development Director. II. Planning Commission hereby grants a variance as applied for authorizing variance with the requirements of Sign Ordinance No. 684 to permit two (2) front wall signs of 75 square feet each, subject to the following conditions: A. Permits shall be required before installation of signs. B. The signs shall be UL listed and in conformance with the master sign plan. C. No other signs will be allowed on the front elevation. D. The existing pole sign for center identification shall be modified to include pole covers and sign cabinets to match the existing master sign plan. This map meets the standards of the PM zone and is in conformance with the Tustin Area General Plan. The conditions of approval are listed in Resolution No. 2076. RECOfI4ENDED ACTION Recomend to the City Council approval of Tentative Parcel Map 82-1026 by the adoption of Resolution No. 2076. The Planning Commission finds and determines as follows: A. That Tentative Parcel Map No. 83-1026 was submitted to the Planning Commission pursuant to Ordinance No. 847 by K.W. Lawler & Associates on behalf of Foster Art Service, Inc. as a three-lot subdivision for a parcel known as portions of Lot 2 of the Stafford and Tustin Tract, as per map recorded in Book 2, pages 618 and 619 of Miscellaneous Records of Los Angeles County, California and Parcel 3 as per map filed in Book 106, pages 31 and 32 of Parcel Maps, Orange County, California. Sharp, Chairman Janet Hester, Recording Secretary DATE: TO: FROM: SUBJECT: February 24, 1983 NEW =~SINESS NO. 1 Inter-Corn Honorable Chairman & Planning Commission Members Community Development Department Telecommunications Center, Olen Warner Park DISCUSSION The Community Development staff has received tenant improvement requests for a telecommunications center for computer services at the Olen Warner Industrial Complex on Warner Avenue. The tenant is AVCO Financial Services. Section IIE2a of Resolution No. 1962, the approving document, stated a requirement for obtaining. City approval for specific uses as follows: "Planning Agency (Commission) review each use and interior improvement plans prior to issuance of tenant improvement contruction permits. Staff has reviewed the accompanying application and back-up information and it appears the use is appropriate for a multiple tenant industrial complex. If the Planning Commission has no concerns, the Building Division will review construction plans and issue improvement permits for the subject use. In addition to the tenant review, the real estate agent for the project has asked for consideration of relief from the review requirement and according to the agent, the possible two-week delay in zoning clearance has caused some potential clients to reconsider lease arrangements. This provision was included in the use permit approval because of concerns by the Planning Agency over the possible location of office firms within the industrial complex. The Planned Community Guidelines for the district prohibited office uses except when "associated with and accessory to" any of the approved industrial uses. The project was designed with sufficient parking for total office use if such uses were authorized. In reviewing alternatives to Planning Commission review, it is possible for the Commission to delegate the responsibility to staff. If this arrangement is satisfactory to Commission members, staff would review and approve all tenant improvements for uses which are obviously within the list contained in the Planned Community District Guidelines or of a type previously approved by Commission action. Staff would continue to bring to the Planning Commission those uses ~ich may be in question.
