REORGANIZATION NO. 53
RECOMMENDED ACTION:
Adoption of Resolution No. 83-10 initiating reorganization procedures and
scheduling a protest hearing for March 21, 1983 for the territory easterly
and westerly of the new Myford Road known as Reorganization No. 53.
BACKGROUND:
The realignment of boundaries between the cities of Tustin and Irvine was
proposed in Environmental Impact Report 78-3 in connection with Annexation
No. 117 in May 1979. The proposal was further discussed in the City of
Irvine Environmental Impact Report for the Walnut Village General Plan
Amendment No. 7 in 1980.
There was concurrence among the cities of Irvine and Tustin and the Irvine
Company that the realignment of Myford Road and the establishment of a
common boundary on the'center line of the road from the City of Tustin
northerly to the southerly limits through the easterly portion of the MCAS
(H) would be in the best interest of the total community. This proposal
was discussed with representatives of the U.S. Marine Corps during numerous
meetings since 1979 and during several changes of command.
The City of Tustin filed a Sphere of Influence amendment and reorganization
proposal with the Local Agency Formation Co~m~ission on November 5, 1980.
LAFCO approved the Sphere of Influence by Resolution No. 81-6 on January
14, 1981 and continued the proposed reorganization to obtain the
concurrence of the U.S. Marine Corps.
The proposal was continued at regular intervals subsequently in order to
obtain the concurrence of the U.S. Marine Corps with the realigned city
boundaries. On January 26, 1983 the Local Agency Formation Commission
approved the proposed reorganization and directed the City of Tustin to be
the conducting authority.
DISCUSSION:
The reorganization transfers 147 acres southerly of Moulton Parkway to the
City of Irvine. This area is inhabited and includes the Military Family
Housig along Harvard Road. The effect would be to separate the military
housing from military operations by City jurisdiction. The City of Irvine
would provide urban services to the family housing residents. The
residents would have access to Irvine parks and recreation facilities.
Irvine emergency services can provide a quicker response to the area with
less travel time than Tustin. The residents use the Irvine streets to
travel to E1 Toro and the most convenient commercial facilities are in the
City of Irvine. An analysis of the proposal indicates that it would be of
benefit to the Marine Corps personnel.
A 96 acre undeveloped parcel northerly of Moulton Parkway would be
transferred to the City of Tustin and would be incorporated into the
industrial ~ark westerly of the alignment of Myford Road.
Since this reorganization contains an inhabited area, the registered voters
of the area are the controlling factor. If a protest to the reorganization
is filed by the U.S. Marine Corps, an election would be required.
Although the cities and Irvine Company were unable to gain the consent of
the Marine Corps Commanding General to this proposed reorganization, there
is no known reason that would justify a protest. The proposed
reorganization is considered by the Local Agency Formation Commission, City
of Tustin, City of Irvine and Irvine Company to be in the best interest of
the total community and the'residents of the area.
A hearing on the proposal is scheduled by Resolution No. 83-10 to be held
on March 21, 1983.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, INITIATING REORGANIZATION
PROCEDURES AND SCHEDULING A HEARING FOR
THE ANNEXATION AND DETACHMENT OF CERTAIN
INHABITED TERRITORY IN THE CITY OF IRVINE
AND THE CITY OF TUSTIN DESIGNATED AS
REORGANIZATION NO. 53
WHEREAS, the Local Agency Formation Commission, by Resolution No.
81-6 on January 14, 1981, determined at the request of the cities of Tustin
and Irvine that the City of Tustin's sphere of influence should coincide
with the center line of the realignment and extension of Myford Road; and
WHEREAS, by Resolution No. 80-109, October 10, 1980, the City
Council of Tustin initiated preliminary proceedings to transfer territory
between the cities of Tustin and Irvine and said proposal was concurred
with by Resolution No. 1240 of the City of Irvine; and
WHEREAS, the proposal was first scheduled for a hearing before the
Local Agency Formation Commission on June 24, 1981 and continued at various
intervals at the request of property owners and interested parties for the
purpose of developing a consensus on the ultimate alignment of Myford Road
to Jamboree, southerly of the Marine Corps Air Station, Tustin; and
WHEREAS, the Local'Agency Formation Commission, at the request of
the cities of Tustin and Irvine, and the Irvine Company, conducted a public
hearing on the proposed reorganization on January 26, 1983 and approved the
proposed '~Municipal Reorganization No. 53" and designated the Tustin City
COuncil as the conducting authority for completing proceedings;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN DOES HEREBY
RESOLVE /LS FOLLOWS:
Preliminary proceedings were commenced by the City Council of Tustin
with the concurrence of the City Council of Irvine and the Irvine
Company.

The City of Tustin and the City of Irvine are affected cities and
district boundaries, including those of the Tustin and Irvine School
Districts, remain unchanged.
The proposed reorganization transfers undeveloped property northerly
of the main line Santa Fe Railroad and westerly of the centerline of
the new Myford Road from the City of Irvine to the City of Tustin.
Inhabited property of the MCAS (H) Tustin easterly of the Peters
Canyon Flood Control Channel and the proposed alignment of Myford
Road would be transferred to the City of Irvine.
The proposed reorganization is for the purpose of realigning the
city boundaries along the realignment of Myford Road to create fixed
and identifiable service boundaries. Residents of the Marine Corps

Housing Project who are the beneficiaries of the City of Irvine
street system, parks and recreation facilities, and emergency
services would be within the jurisdictional limits of the City of
Irvine.
The Local Agency Formation Commission on January 26, 1983 certified
that the transfer of the subject parcels will not have a significant
effect on the environment; designated the Tustin City Council as the
conducting authority; authorized a protest hearing; and determined
that the expenses for conducting the proceedings shall be paid by
the City of Tustin, except as otherwise provided by agreement with
the interested agencies.
A public hearing will be conducted by the City Council of Tustin at
7:30 p.m. on March 21, 1983 in the Council Chambers, 300 Centennial
Way, Tustin, California. Any interested person desiring to make
written protest against the proposed reorganization shall do so by
written communication filed with the City Clerk of Tustin not later
than 7:30 p.m., March 21, 1983. Any owner of land or any registered
voter within the territory proposed for annexation may file a
written protest with the City Clerk of Tustin at any time prior to
the conclusion of the City Council hearing on the proposed
reorganization.
The City Clerk shall cause notice of hearing on the proposed
reorganization to be given as required by law.
PASSED AND ADOPTED by the City Council of the City of Tustin at a
regular meeting held on the 7th day of February, 1983.
