Mayor Edgar ~rovided' Mr. 8rnce with a c~py of the staff report .. dated Jan,,~y 4, 1~83, prepared by the Chief of Police and tabled the matter to allow Mr. Bruce an opportunity to read and review s~me · IIX · Council_man ~reinke expressed his pez-turbation with C~unicom' s delay in cable television service ~o Tus~/n residents, as a resident h~ m~elf. The public hearing was opened by the Mayor. There being no speakers on th~ matter, the public hearing was closed. APP~0VAL ~ ~ - January 3, 1983 w~-T- in the amount of $196,440.57 the amount of $830,348.99 5O R~Oii NO. 83-4- A Resolution of the City Council of the City of Tustin ACCEPTING WORKS OF IMPROVEF~D~T AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION (1981-82 Miscellaneous Park Improvements - ACME Pipeline & Engineering) Adopt Resolution No. 83-4 and assuming no cla~m~ or stop payment notices are filed within 30 days of the date of recordation of t_he Notice of Completion, authorize payment of the final 10% retention amount as recommended by the Engineering Department. 77 CIT~ ~ ~R P~ ~ ~ E~ 14321 Remove the tree as requested and replace with one from the City-approved list with no cost to the homeowner as recom- mended by the Maintenance Superintendent. 86.1 C~= Ca~e~-~ Ite~ 3 - Water Serviom Ra~e~ - Mayor Edgar noted =hat Council action established the ~oncept of a monthly fee rather than a bi-monthly fee, and requested that the resolution reflec~ same. The City Manager recognized that the City is still on a bi- monthly system and is looking at the feasibility of converting to a monthly system. However, this involves some problems · Also, the Mayor requested that Section A-5 list only totals with an additional sentence' that deD~ service surcharges be USed for payment of bonds · or acquisition. It was then moved bl~ Edgar, seconded by Saltar~lli, to adopt the following resol, ution with changes reflecting monthly fees and that Section A-5 list only the totals with an additional sentence inserted that debt service surcharges can be USed to pay off bonds or acquisition: 3. RE,~E~ITIO~ NO. 83--7- A Resolution' of the City Council of t.he City of TUStin, ADJUSTING WATER SERVICE RATES In response to Councilman Greinke, t_he City Manager indicated that staff would report back on converting to a monthly billing system, noting 'that it is simply not a matter of reprogr-mming the computer, but involves cost implications for field and office personnel. Motion carried 5-0. 107 M~ller C~m~zity Cen~er - The Director of Public Works responded to Mayor Edgar that the ~,antity change in decreased carpeting and increased linoleum was requested by the Director of Community Ser- vices and will allow for easier m~intenance where food serving takes place· It was then moved by Kennedy, seconded by Edgar, to adopt the following resolution: RF~qQI/F~ION NO. 83--6- A Resolution of the City Council of the City of Tustin, California, APPROVING SPECIFICATIONS FOR REMOVAL AND REPLACEMENT OF CARPETING AND LINOLEUM IN CLIFTON C. As reco-~nded by the Director of Public Works, ~t was moved by Kennedy, seconded by Edgar, to dtrec~ staff to prepare preliminary plans for sidewalks on bo~h east and west sides of Pacific Street and allow the residents to respond. Carried 5-0. 92 The Director of Public works presented the staff repoz~ as con- rained in the inter-eom dated January 12, 1983, ~repared by the Public Works Department. Co%~lcilma~ Greinke requested that ~ Council desires to rabid the itet~, ~hat heav~-duty t.r~¢k manufactureres be invited to bid, ra~her that dealers. Councilm~/% Saltarelli felt that agen- cies who failed to bid due to an oversight should not be allowed to rabid on the item. Councila~an Hoesterey concurred wi~h Councilman Grsinke~s concern that the m~nufac~curer be contacted direc"cly, bu~ in this instance the original bid be awarded. The Direc~cor of Public Works pointed out that the stencil truck is a one-ton chassis, so it is not really heav~-duty, but the body and bid ars ~otally c~st°~izsd. It was then moved by Hoes=stay, seconded by Sal=arslli, to authorize purchase of one replacement stencil ~ruck from Bauer Coatings & Chemicals, Div. of Whittaker Corp., Los A~geles, for the bid price of $31,204.03. Cax-ried 4-1, Greinke opposed. · 87 14701 In response ~o ~he Mayor, Mr. Bruce clarified that in reaction to the rmpor~ dated Januax~ 4, 1983, prepared by the Chief of Pol£ce., he was no~ advocating tur~inq the ~arking lots into RV storage lots. He commented that he was misquoted in Item ~ of the repor~ - the state, s_n= "nail him" was made by Kathy Wail, no~ him~ and secondly, he disputed the cle~- that a crime prob- le~ exists, 'based on his experience of living next =o t.he park- ing lot the pas= five years. Mr. Bruce thanked the Council for Council~ Greinke stated that the matter is clearly a CC&R ~roblem under the Tustin Meadows Homeowners~ Association juris- diction, and the Council is not the appropriate body to address Council concurred to receive and file the r~oz~c. 74 The City Manager presented the staff report and recommendation. Mayor Pro Tern Kennedy made reference to Councilman Greinke's request for a caravan tour of t_he project area. Council con- cuffed to schedule the caravan tour on Saturday, January 22, 1983, at 9:00 a.m. After Council discussion, it was moved b~ Kennedy, seconded by Saltarelli, to approve the actions required to be taken by the Council to proceed with the South/Central Redevelopment Project Area as contained in the report dated January 12, 1983, prepared by the City Manager. Carried 5-0. 63 · Following consideration of the report dated January 11, 1983, prepared by ~he Public Works Department, it was moved by Greinke, seconded by Hoestere¥, to au~.horize purchase of ten radios and accessory equipment as needed from ICS C~,mications for the bid price of $11,131.06 as recommended by the Director of Public Works/City Engineer. In response to Mayor Pro Tern Kennedy, the City Manager stated that the radios would provide the ability to dispatch in the field, resulting in greater efficiency, for water department CT ewe · The motion carried 5-0. 87 The City Manager presented the staff report and recommendation. Council/staff discuasion followed. It wes then moved bY' Saltarelli, seconded by Hoesterey, to authorize staff to prepare, an agreement between the City and Irvine Cu.~eny concerning preparation of the Peters Canyon Area land use study as reco~nended by the City Manager in his report dated January 12, 1983. Following further discussion, the motion carried. 5-0 · 81 REPORTS 1. COUNCIL R~ERR~L - PAREI~ IRVINE ~lDOS'~rra'r. ~ The report dated January 4, 1983, prepared by the Chief of Police was received and filed by unan~-nous informal consent. 74 3. BIII'"r-~'T ~ The City Manager provided an oral update on the matter, stating receipt of t_he NOVA film is expected by the end of the month; staff is compiling a fac~ sheet to clarify any misinformation that has been passed on, i.e., what the PUC can/cannot do, cur- rent legislation, AB4, the application of CEQA laws in terms of the bullet t. rain; staff will attend the hearing of the Assembly Transportation Committee which was rescheduled from last Friday to Jan-~y 21, 1983; and the Tustin Meadows Homeowners' Associ- ation will hold an infozlnational meeting January 25, 1983, at which a staff men~ber will be present to update them on the City' s actions. Intensive Council discussion followed on strategy to gain sup- port of Orange County cities in requiring environmental review on the matter. Council concurred to take the following actions: a) In reference to the League of Cities meeting scheduled on Febr~,a~y 10, 1983, an invitation will be sent to each Leaque m-tuber, asking the~ to arrive at the Stadium Club at 5:30 for refreshments, to encourage better attendance for viewing of the NOVA film. b) Staff will explore the possibility of editing the film, highlighting the narration portion which points out that the system is outdated. CITY COUNCIL M/NUTES Page 5, 1-17-83 c) Consider hiring an engineering consultant for expert tech- nical assistance in evaluating the matter, which will prove most val,,-hle in PUC hearings. Councils-tubers will make personal contact with the o~her 25 Orange County cities, dividing the n,~her of cities equally among Counc~lm~hers, to clarify Tustin's position on matter and request support of same. 101 Councilman Greinke reported that he was appointed by t_he League of Cities ~o the State C~ittse on Transportation and will keep the Council advised of a~ivity in this area. 73 Councilm-n Greinke requested staff investigate the feasibility of converting t.he most southerly of the two left-turn lanes at First and Newport in~o an optional lane, allowing drivers to turn left and/or proceed s=ra£ght (easterly) on First S~reet. Councllm~n Greinke also suggested that watering of the medians be rescheduled for earlier in the day (mornings). In response to Councilman Greinke, the Director of Public Works provided an update o~ t.he grant s~atus for synchronizing traffic signals for improved traffic flow within the City, reporting ~hat Tustin was not chosen as a recipient this year, but he is .confident that Tus=in will be & recipient nsxt year. 94 The Director of Public Works indicated staff will check the. traffic signals on Newpor~ avenue 'for malfunc~ioning control- lers. The Director of Public Works responded to Mayor Edgar that staff is s~lll awaiting right-of-way certifica~ion on plans.
