ALLEY VACATION AND ABANDONMENT - PUBLIC NEARING
RECOMMENDATION:
Upon completion of the public hearing, and if the City Council desires to vacate
and abandon a portion of the subject alley, it is recommended that the attached
resolution be passed'and adopted.
BACKGROUND:
At their meeting of December 20, 1982, the Tustin City Council adopted Resolution
No. 82-92 declaring its intention to vacate and abandon a portion of an alley
between E1Camino Real and "C" Street and northerly of Second Street, and fix a
time and place for the public 'heering thereof.
The public hearing has been set for the January 17, 1983 Council meeting at 7:30
PM. After this public hearing has been completed and if the City Council so
desires to vacate and abandon that portion of the subject alley, the attached
resolution will require adoption by the City Council.
This abandonment proceeding was initiated by two property owners adjacent to said
alley at 170 E1Camino Real and at 175 "C" Street.
The property owner at 175 "C" Street is developing the property as an office
building and has recently obtained approval of Variance No. 82-9 by the Tustin
Planning Agency.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
ORDERING VACATION OF A PORTION OF AN ALLEY BETWEEN EL
CAMINO REAL AND "C" STREET AND NORTHERLY OF SECOND
STREET
The City Council of the City of Tustin, California, does hereby
resolve as follows:
1. The City Council finds and determines:
The City Council duly adopted its Resolution No. 82-92,
declaring its intention to vacate and abandon a portion
an alley shown on Exhibit "A" attached hereto and
incorporated herein by this reference, and fixing a Time
and Place of Public Hearing thereon.

b. Said Resolution has been duly published according to law,
and
c. Said Notices of said hearing have been posted as required
by law, and

A public hearing has been duly called, noticed, and held
according to law, and all persons interested in or
objecting to the proposed vacation and abandonment
appearing at said hearing were heard.
e. Said portion of subject alley is not necessary for present
or prospective alley purposes, except for public utilities.

That the Planning Agency, by adoption of Resolution No.
2068, dated December 20, 1982, has determined that the
subject property should be declared excess to the City's
needs and disposed of for private development.
g. Categorical exemption from EIR requirements.
2. The City Council hereby orders the vacation and abandonment of
that portion of an alley designated on Exhibit "A" attached hereto, subject
to the reservation of easements per Section 8330 of the.Street and Highway
Code.
3. The City Clerk is directed to cause a certified copy of this
Resolution, duly attested by the City Clerk under the seal of the City, to be
recorded in the office of the County Recorder of the County of Orange.

EXHIBIT "A"
Vacation and abandonment of a portion of an alley between E1
Camino Real and "C" Street and northerly of Secton Street.
Those portions of Lots 3 and 18, Book 4, of the Tustin City tract
as shown on a map recorded in Book 4, Page 218, Miscellaneous
Records of Los Angeles County, California, described as follows:
The westerly 10.00 feet of Lot 3, Block 4, of said Tustin City
Tract and the easterly 10.00 feet of Lot 18, Block 4, of said
Tustin City tract.
