Tustin Meats As was indicated in the memo of December 8, 1982, the tank was installed in the storage area as indicated in the plan approved for the expansion of the non-conforming meat operation by Variance No. 68-4. The owner was informed this would be the only permitted location and any impact on the storage of racks or pallets on other portions of the lot because of the installation would have to be mitigated by the owner. In addition, visual screening of the tank would have to be installed in accordance with the original conditions of approval of the subject variance. The owner has indicated he intends to enclose the entire rear area with solid wall fencing and rolling gate, both as screening and security. On December 28, 1982 at 2:00 p.m., a demonstration was held by Liquid Air, Inc. (installer and supplier) and the owner, Mr. Asher, to explain the installation, safeguards and the inert non-flammable properties of liquid nitrogen. Those in attendance included Mayor Edgar, Mayor Pro Tem Kennedy, Mr. & Mrs. Walter Fl aherty, Fire and Community Development staff, and other interested citizens. Discussions on potential spills, the immediate absorption of a spill into the atmosphere, procedural and physical safeguards, maintenance, delivery mechanisms, the natural and non-polluting qualities of nitrogen and other items of concern took place in an informal manner. It appeared to be the consensus of the majority in attendance that the installation was safe and presented no threat to the immediate area. Further, the enclosure of the property by a masonry wall and gate would reduce potential vandalism or operation by unauthorized personnel. It was also pointed out that a federal inspector, knowledgeable in this regard, is on the premises during all hours of operation. In response to allegations that the operation and/or installation violate provisions of S.9273, NON-CONFORMING USES AND STRUCTURES, of the Tustin Municipal.Code, made by Mr. Flaherty at the December 20, 1982 regular meeting, it is staff's contention that Variance 68-4 exactly addressed that issue and has been the basis under which the business has been conducted since that time.
