OLD BUSINESS NO. 1
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, GRANTING AUTHORITY TO VARY
WITH THE OPEN SPACE REQUIREMENTS OF THE
PLANNED DEVELOPMENT DISTRICT AND PERMII'I'ING
THE CONSTRUCTION OF 41 CONDOMINIUM UNITS AT
15520 THROUGH 15582 SOUTH "B" STREk'T.
The Planning Agency of the City of Tustin does hereby resolve as fol-
lows:
I. The Planning Agency finds and determines as follows:
That a proper application (Variance No. 81-9) was filed by
Graham Electronic on behalf of Beyer and Warden, Inc., to re-
quest authorization to vary with the open space requirements
of the. Planned Development (PD) District to construct 41 res-
idential condominium units at 15520 through 15582 South "B"
Street.
B. l~at a public hearing was duly called, noticed and held on
said application.

That because of special circumstances applicable to the sub-
ject property, relative to size, shape, topography, location
or surroundings, a strict application of the Zoning Ordinance
is found to deprive the subject property of privileges enjoy-
ed by other properties in the vicinity and under identical
zone classification, evidenced by the following findings:
1. The use is in conformance with the land use element of
the Tustin Area General Plan.
The site configuration, which was subdivided under county
jurisdiction, presents a hardship to design within Plan-
ned Development standards.
That the granting of a variance as herein provided will not
constitute a grant of special privilege inconsistent with the
limitations upon other properties in the vicinity and dis-
trict in which the subject property is situated.
E. That this project is categorically exempt from the require-
merits of the California Environmental Quality Act.
That the granting of the variance as herein provided will not
be contrary to the intent of the Zoning Ordinance or the pub-
lic safety, health and welfare, and said variance should be
granted.

II.
Proposed development shall be in accordance with the develop-
ment policies adopted by the City Council, Uniform Building
Codes as administered by the Building Official, Fire Code as
administerd by the Orange County Fire Marshal, and street im-
provement requirements as administered by the City Engineer.
H. Final development plans shall require the review and approval
of the Community Development Director.
The Planning Agency hereby grants a variance as applied for, to
authorize construction of a 41-unit condominium project with 47%
open space, subject to the following conditions:
Compliance with the Subdivision Map Act by the submission of
Tentative Tract Map, the recordation of a Final Map and of
covenants, conditions, and restrictions for the project prior
to the issuance of building permits.
The developer shall be required to have a Civil Engineer pre-
pare improvement plans for "B" Street and'should be required
to construct all missing or damaged street improvements adja-
cent to said development per the City of Tustin "Minimum De-
sign Standards for Public Works" and "Street Improvement
Standards."
C. The developer shall provide a sanitary sewer in "B" Street to
service the property.
The developer shall be required to pay sewer connection fees
to the Orange County Sanitation District, per their Ordin-
ance.
D. The developer shall provide a domestic water line in "B"
Street to service the property.
E. Re-dedication of the public right-of-way and additional dedi-
cations for public right-of-way shall be required.
F. Street trees shall be provided along "B" Street at 40 feet on
center.
G. The interior drive aisle shall be a minimum of 27' wide.

A sound attenuation wall, designed by an acoustical engineer
shall be provided along the Santa Ana Freeway frontage to re-
duce the on-site noise level at the first floor height, to 65
db(A).
I. A final grading plan shall be required for review and approv-
al.
J. Payment of East Orange County Sanitation District fees in the
amount of $500.00 per dwelling.

The most northerly driveway is near the curvature of "B"
Street and Nisson Rd. The actual curved alignment of the.
roadway should be shown on the site plan to determine if
there are any traffic hazards with the location of the
driveway location.
Smoke detection system shall be provided and installed in
accordance with UBC Section 1310. The detectors shall be
State Fire Marshall approved.

One on-site fire hydrant and one public fire hydrant on "B"
Street shall be provided in conjunction with this
development.
N. That the roof covering shall be of non-combustible material
for increased fire protection.
O. Show existing hydrants in vicinity on plans.
P. Measures shall be taken to insure no parking along private
drive which must serve as fire department access.
Q. Coordinate fire department entry through security gates with
Capt. Stoll (538-3551).
R. Installatin of residential sprinkler system for three (3)
story structures per Uniform Building and Fire Codes.
S. Planting and irrigation plans shall be submitted with
building plans for review and approval.
T. Payment of Parkland dedication fees for units which are in
excess of existing units.

Permits must be obtained for all signage to include
construction signs, for sale signs and tract identification
signs.

This Variance (81-9) shall be null and void if not used
within six (6) months from the date of the approval of this
resolution.
W. This project shall be a completely secured community to
include security gates at driveway and walkway entrance.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning Agency
held on the day of , lg81.
