ROURKE, CITY ATTORNEY ROBERT L. LAVOIE, DEPUTY CITY ATTORNEY AMENDMENT OF THE PERSONNEL RULES AND REGULATIONS TO DEFINE "RESERVE OFFICER" Recently the Police Department inquired whether a reserve officer must be afforded the right of a pre-termination hearing prior to informing the reserve officer that his services are no longer desired by the City of Tustin. In reviewing this matter we noted that the Personnal Rules and Regulations do not define the status of a reserve officer directly, although his status could be determined by looking at other provisions of the Rules and Regulations. This office thereafter proposed that the Per- sonnel Rules and Regulations be amended to directly define "reserve officer" and pursuant to that recommendation the Chief of Police has requested that this office prepare a Resolution for the City Council to affect this change. Pursuant to that request, please find attached to this Inter-Com a proposed Resolution for adoption by the City Council. We welcome any comments which you may have concerning the draft Resolution and we request that it be processed for adoption by the City Council. RLL:lw:D:ll/25/81 cc: Chief of Police City Clerk 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 24 25 26 27 28 RESOLUTION NO. 81-136 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE PERSONNEL RULES AND REGULATIONS TO DEFINE THE RIGHTS OF RESERVE OFFICERS. The City Council of the City of Tustin, California, does hereby resolve that Section 2A of the Personnel Rules and Regulations of the City of Tustin is amended to add the definition of "Reserve Officer" to read as follows: "Reserve Officer - any person serving the City of Tustin as a volunteer, reserve or auxiliary police officer. Such person shall not be considered to have attained a regular appointment to either a permanent or part-time position. Every reserve officer shall serve at the pleasure of the Chief of Police and may be terminated without the right of pre-disciplinary hearing or riqht of appeal."
