It is recu,,,~nded that the City Council, at their meeting of Dec. 21, 1981, pass
and adopt the attached resolution approving plans and specifications for subject
project and directing the City Clerk to advertise for bids.
BACKGRO3bD:
Subject project enoc~passes modifying the center medians on Irvine Blvd. at Mtn.
View and at "A" Street to provide east bound left turn pockets.
This project evolved after the City, upon request of the Police DePartment, posted
'~o Left Turn" and '~o U Turn" signs on eastbound Irvine Blvd. at "A" Street and
Mtn. View. There had been numerous rear end type accidents at these locations due
to motorists stopping in the east bound fast lane to turn left into the office
building ccmplex on the north side of the street. Shortly thereafter, numerous
C~L~laints were received frcm the businessmen in this ~plex and the City
subsequently regDved the '~o Left Turn" signs and staff requested Co~mcil to
allocate funds to oonstruct left turn pockets. The City Council, at their meeting
of August 17, 1981, appropriated $15,500.00 in General Fund monies for this work.
Due to the existing configuration of the medians, the project will involve re,oval
of a n~dian tree at both Mtn. View and "A" Street in order to permit construction
of adequate size turn pockets. The remaining island between Mtn. View and Yorba
St. will be a 4' wide "snake" type median due to the new pocket's close proximity
to the west bound left turn pocket for Yorba St. The intent is to temporarily
leave this island in dirt until such time that our FAU project for median island
construction on Irvine Blvd. between Prospect Ave. & Newport Ave. is underway
(estimated construction, Spring of 1982). This project calls for stamped concrete
in the medians and at that time we will have stamped concrete installed at the
"snake" median between Mtn. View and Yorba Street. Landscaping at the "A" Street
median will be restored by City crews ~,;u;~=diately after this project is c~.pleted.
The Engineer's estimate for this project is $16,000.00.
The tentative schedule for this work is as follows:

~I~EREAS, it is the intention of the City Council of the City of Tustin,
California to construct center median modification improvements on Irvine
Blvd. frcm Yorba Street to "A" Street, and;
~{EREAS, the City Engineer has presented plans and specifications for
the construction of said work;
NG~ THEREFORE, BE IT RESC~V~D that the plans and specifications
presented by the City Engineer be and are hereby approved as the plans and
specifications for:

BE IT FUll, ER RESOLVED that the City Clerk is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or
proposals for the doing of the work specified in the aforesaid plans and
specifications whirl% said advertisement shall be substantially in the
following words and figures to-wit:

Tustin City }]all, 300 Centennial Way, Tustin, California, until 9:00 A.M. on
the 12th day of Jan., 1982, at which time they will be publicly opened and

The foregoing quantities are a ~.pproximate only, being given as a basis for
the c~,~arison of bids, and the City of Tustin does not, expressly or by.
implication, agree that the actual ~nount of work will ~orrespond therewith,
but reserves the right to increase or decrease the amount of any class or
portion of the work or to c~it portions of the work as may be deemed necessary
or advisable by the Engineer.
Plans, specifications and proposal forms to be used for bidding on this
project can only be obtained by prospective bidders at the office of the City
Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, 92680, upon
payment of $5.00 per set, which m~ount shall be non-refundable.
Plans and specifications will be mailed out upon payment of $10.00 per
set, which amount shall be non-refundable.
In conformance with Section 37931 of the Government Code, all bids shall
be presented under Sealed cover on the proposal form provided and accc~panied
by one of the following forms of bidder's security:
a. Cash
b. Cashier's check made payable to the City of Tustin.
c. Certified check made payable to the City of Tustin.
d. Bidder's bond executed by an accredited surety insurer,
made payable to the City of Tustin.
The security shall be in an amount equal to at least ten percent (10%)
of the 8mount of the bid. A bid shall not be considered unless one of the
forms of bidder's security is enclosed therewith.
A Security Bond for payment of labor and materials will be required in
the ~m~ount of fifty percent (50%) of the estimated total contract price and a
Faithful Performance Bond in the amount of one hundred percent (100%) of the
estimated total contract price in the form attached to the contract
documents. Said bonds shall be issued by a Surety Company rated grade A or
better and Class IX or better by the latest edition of Best's Key Rating
Gu ide.
City of Tustin reserves the right to reject any or all bids, and/or
waive any informality on a bid. No bidder may withdraw his bid for a period
of thirty (30) days after the date set for the opening thereof.
The contract will be awarded to the lowest qualified bidder.
Provisions of the State Contract Act are not applicable, and prospective
bidders will not be required to be prequalified.
Ail work to be done under the direct supervision of the City Engineer,
City of Tustin.
Ail work to be paid for at the unit prices bid frcm appropriated monies.

The City Council of the City of Tustin has obtained frcm the Director of
Industrial Relations the general prevailing rate of per diem wages and the
general prevailing rate for legal holiday and overtime work in the locality
in which the work is to be perforn~=d for each craft or type of work needed
and a copy of the ssa~ is on file in the office of the City Clerk.
Not less than said prevailing rates shall be paid to workers ~,~loyed on
this public works contract as required by Labor Code Sections 1771 and 1774
of the State of California.
