That bhe Tustin City Council, at their neeting of December 21, 1981, direct staff
to investigate the offer of the Bench Ad Co. to place bus benches at bus stops
throug{~cut the city and at no <Dst to the city, per the conditions outlined in
this staff report.
BACKGRO3bD:
City Ordinance No. 684, Article VIII-Regulations, Section I, regulates the
plac~nt of advertising benches within the City as follows:
No person shall place upon the ri~ht-of-way of any public street or any
public safety area within the City any benches or seats upon which any
advertising matter shall be painted or otherwise affixed, except at
authorized bus stops and in compliance with the following conditions:
1. Initially applying for and obtaining a written permit from the City
Council.
2. Obtaining the approval of the City Engineer for the design and
construction of benches.
Bench Ad Ccmpany is a firm that installs, maintains and operates benches
throughout the State of California. These bend~es have traditionally carried
various multi-color advertisements across the bade of the bench and a painted
green wood sitting surface. In November, 1981, Bench Ad by letter has requested
the City to reconsider its policy of prohibiting advertising benches within the
public right of way. (Copy attached. )
In a telephone conversation with Bench Ad Co., it was indicated that not ail
benches placed within the City would require advertising; sc~e benches could be
left plain, or City logos and messages could be placed on the benches. However, a
percentage of the benches placed within the City will require advertising. The
type of advertising and color of the benches could be regulated by the City.
In January, 1982, Bench Ad will have a new bench design as shown on the attached
drawing. I will have a colored drawing of the new design available at the Council
meeting if needed. This new design with controlled advertisements (depending upon
the color schem~s) appears that it could be compatible with Tustin's policies.

Approximately 50% of the O.C.T.D. bus stops within the City have benches
containing no advertisement. These benches that have been provided w~re funded
solely by the City. About three years ago, at the request of O.C.T.D., the City
applied through the District to the Urban Mass Transit Authority (U.M.T.A.) for a
grant to fund the purchase of bus benches. To date, we have had no
acknowledgement from either U.M.T.A. or O.C.T.D. as to the status of this
request. The estimated cost for purchasing benches to provide a minimum of one
bench at each stc~ is $8,000 - $8,500.
It is suggested that staff pursue the offer of Bench Ad Co. and determine the
exact requirements of what they require to place benches with and without
advertising at bus stops located within the City. Additional areas of
investigation will be color of benches, type of advertising and color schem~s, and
required number of benches with advertising as c~,~ared to those without
advertising.

I am writing you on behalf of Bench Ad Company in the hopes of
extending our service to the City of Tustin. As a form of
introduction, I wish to briefly provide you with information
about our company and how it will aid your community.
Bench Ad Company is Californias largest supplier of courtesy
bus benches. Bench Ad Company has installed, maintains and
operates approximately 25,000 benches throughout the State of
California. Our company has had an excellent relationship with
OCTD for many many years which serves Tustin. Bench Ad Company
works closely with this agency to extend, its service throughout
the county area.
Since the establishment and growth of certain transit lines in
your City, Bench Ad Companys service agreement provides that we
will install and maintain benches at absolutely no cost to the
City or transit line.
We would be happy to work with you and your staff in regards to
Public service, esthetic requirements, or any other items regarding
bench placements. In certain areas, Bench Ad Company would
maintain ad free benches at no cost to the City.
I have enclosed a picture of our new bench which will be ready
January 1982. I feel this bench would be excellent for the
City of Tustin. Please contact me at your convenience so we can
meet and discuss a bench program For the City of Tustin.
