Ordinance No. 862 .... "Requirement of Use Permit for Multiple Unit
Projects Exceeding One-Story or Twenty Feet in Height when Abutting

RECOMMENDATION:
Adopt Resolution No. 2005 recommending to the City Council adoption of
Ordinance No. 862.
BACKGROUND:
This ordinance was prepared with the specific and limited intent of requiring
all multiple unit developments to meet the same standards for review and action
by the Planning Agency as currently required for PD, condominium projects.
Council has expressed concern over definitions and "how heights are measured."
If any further modifications of City Code result from such concerns, it would
not include these ordinance provisions. This ordinance merely establishes
uniform review requirements on all multiple unit projects.
Under New Business on the Planning Agency Agenda, staff has prepared a brief
graphic presentation on how height measurements are conducted, the impact of
grade differentials and the height restrictions of our various zoning
districts. At that time additional directions as to future amendments would be
appropriate.

RESOLUTION NO. 2005
A RESOLUTION OF THE TUSTIN PLANNING AGENCY RECOMMENDING TO THE
CITY COUNCIL ADOPTION OF ORDINANCE NO. 862 , AMENDING THE
HEIGHT RESTRICTIONS IN THE MULTIPLE FAMlq]~--O'ISTRICTS
The Planning Agency of the City of Tustin does hereby resolve as
follows:
1. The Planning Agency finds and determines

That the City Council directed City staff to review and draft
regulations to amend height restrictions in the multiple family
districts.
B. That a public hearing was duly called, noticed and held on said
amendments.
That the height restrictions in the Zoning Code do not
adequately protect the character of neighboring single story,
single family districts, and they should be amended.
The Planning Agency hereby recommends to the City Council that the
height limitations of the R-2, R-3, R-4 and Planned Development
(PD) Districts be amended as set forth in draft Ordinance No. 862.
PASSED and ADOPTED at a regular meeting of the Planning Agency of the
City of Tustin, held on the of , 1981.
