REQUEST:
Authorization to operate a church and private school at the site of a vacant
public school complex.
RECOMMENDED ACTION:
Approval of Use Permit No. 81-33 by the adoption of Resolution No. 2010.
BACKGROUND & DISCUSSION:
The C. E. Utt Intermediate School occupies a 20-acre site on the east side of
Tustin, bordered by Bryan Avenue, Browning Avenue, and San Juan Street. The
Tustin Unified School District closed the operation as a school in June, 1978.
Irvine Unified School District leased the site as a public school until June,
1981.
The Colonial Bible Church wishes to use the site as a private school (grades
K-12), a church, and for evening adult religious instruction. The times and
attendance for each activity would be as follows:

- 300 morning service, Sundays
250 afternoon service, Sundays
200 evening (to 9:00 p.m.) service, Sundays
- Adult and youth attendance, approximately 100,
Tuesday nights
One hundred on-site parking spaces would be needed to accommodate the largest
meeting, 300-person morning church service. The present school parking area
has only 44 spaces. The applicant has stated that the church is willing to add
additional parking to satisfy minimum City requirements. The church would,
however, like to start having services before the parking area is finished.

FINDINGS & CONCLUSIONS:
One hundred on-site parking spaces should satisfy the demands of the pro-
posed use and should be required. The on-site parking areas should also
confom to present City standards.
2. The activities requested, church services and private instruction, are very
similar in nature to public school activities and should be authorized.
3. The structures used for private instruction and assembly should confom to
existing provisions for such uses in the Uniform Building Code.

RESOLUTION NO. 2010
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF
TUSTIN, AUTHORIZING USE OF THE C. E. UTT INTERMEDIATE
SCHOOL SITE FOR A CHURCH AND PRIVATE SCHOOL FACILITY
Agency of the City of Tustin does hereby resolve as follows:
Planning AgenCy finds and determines as follows:
That a proper application (Use Permit No. 81-33) has been filed
on behalf of Colonial Bible Church to operate a church and pri-
vate school at the C. E. Utt Intermediate School site at 13601
Browning Avenue.
That a public hearing was duly called, noticed and held on said
application.
That establishment, maintenance and operation of the use applied
for will not, under the circumstances of this case, be detri-
mental to the health, safety, morals, comfort or general welfare
of the persons residing or working in the neighborhood of such
proposed use, evidenced by the following findings:
This use is in conformance with the Land Use Element of the
Tustin Area General Plan and with the Public & Institutional
District of the Zoning Code.
That the establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property, nor
to the general welfare of the City of Tustin, and should be
granted.
Proposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
administered by Orange County Fire Marshal, and street improve-
ment requirements as administered by the City Engineer.
F. This project is categorically exempt from the requirements of the
California Environmental'Quality Act.
G. Final development plans shall require the review and approval of
the Community Development Department.
II.
The Planning Agency hereby adopts Use Permit No. 81-33 to authorize
operation of a church and private school at 13601 Browning Avenue, as
applied for, subject to the following conditions:

That an improved parking area for one hundred (100) automobiles
shall be constructed on-site within six (6) months of the date of
this resolution.
B. That construction plans shall be sUbmitted for review and
approval for all on-site improvements.

That use of the existing structures shall be in conformance with
the Uniform Building Code and any modifications of the structures
shall be done in accordance with Building Code regulations.

That the applicant shall allow provide for the parking of
congregation vehicles in the playground areas until the improved
parking lot is completed.
PASSED AND ADOPTED at a regular meeting of the Planning Agency held on
