A Resolution of the City Council of the City of Tustin, California,
APPROVING THE DESTRUCTION OF CERTAIN RECORDS
BACKGROUND:
The following Department Heads request authorization to destroy certain
records of their departments which have been retained for at least two
(2) years according to Government Code Section 34090:

DESTRUCTION OF RECORDS.

Pursuant to the request of your office, attached is a proposed
resolution authorizing destruction of certain City records for
presentation to the City Council.

Mary had suggested the possibility of one resolution such as Garden
Grove uses which would authorize destruction of records for the
present and in the future without the necessity of any other resol-
utions in the future. We have looked at that procedure and we do
not believe it would be compliance with legal requirements and for
that reason we are not proposing such a procedure for Tustin.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFOrnIA, APPROVING THE
DESTRUCTION OF CERTAIN RECORDS
WHEREAS, except for records affecting title to real
property or liens thereon, court records, records required to
be kept by statute, records less than two years old and the
minutes, ordinances, or resolutions of the City Council and
other City boards or commissions, Government Code Section
34090 authorizes the head of a city department to destroy any
city record, document, instrument, book or paper, under his
charge, without making a copy thereof, after the same is no
longer required, with the approval of the City Council by
resolution and the written consent of the City Attorney; and
WHEREAS, the City Council, upon the request of the
Personnel Director, desires to approve immediate destruction
of certain Personnel Department records, to-wit, applications
for employment and testing materials which, as of September
30, 1981, have been retained for at least two (2) years; and
WHEREAS, the City Council, upon request of the Community
Services Director, desires to approve immediate destruction
of certain records of the Community Service Department, to-wit,
incoming and outgoing correspondence of the period January
1, 1972 through December 31, 1978, receipts and payroll
ledgers of the period from January 1, 1972 through December
31, 1978, inter-departmental memoranda of the period January
1, 1971 through December 31, 1978, and miscellaneous depart-
mental files and records of the period January 1, 1972 through
December 31, 1978; and
WHEREAS, the City Council, upon request of the Community
Development Director, desires to approve immediate destruction
of certain records of the that department, to-wit, miscellaneous
correspondence of the period January 1, 1970 through December
31, 1978 and duplicate materials relative to zone changes of
the period prior to December 31, 1978; and

WHEREAS, the Council, upon request of the City Manager,
desires to approve immediate desctruction of certain records,
of the City Manager's Office to-wit, correspondence and
miscellaneous memoranda and papers of the City Manager's
Office, each of which is not less than two (2) years old;
and
WHEREAS, the City Attorney of the City of Tustin has
filed his written consent for the destruction of such records
with the Clerk of the Council of the City of Tustin;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Tustin:

Pursuant to Section 34090 et. seq. of the Government
Code of California, approval is hereby granted for the
immediate destruction of the items listed below which, as of
January 1, 1981, have been retained for a minimum of two (2)
years:
1. Personnel Director desires to approve immediate
destruction of certain Personnel Department records, to-wit,
applications for employment and testing materials which, as
of September 30, 1981, have been retained for at least two
(2) years; and
2. Community Services Director desires to approve
immediate destruction of certain records of the Community
Service Department, to-wit, incoming and outgoing correspond-
ence of the period January 1, 1972 through December 31,
1978, receipts and payroll ledgers of the period from January
1, 1972 through December 31, 1978, inter-departmental memoranda
of the period January 1, 1971 through December 31, 1978, and
miscellaneous departmental files and records of the period
January 1, 1972 through December 31, 1978; and
3. Community Development Director desires to approve
immediate destruction of certain records of the that depart-
ment, to-wit, miscellaneous correspondence of the period
January 1, 1970 through December 31, 1978 and duplicate
materials relative to zone changes of the period prior to
December 31, 1978; and
4. City Manager desires to approve immediate desctruc-
tion of certain records, of the City Manager's Office to-wit,
correspondence and miscellaneous memoranda and papers of the
City Manager's Office, each of which is not less than two
(2) years old; and
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the
day of , 1981.

CONSENT OF CITY ATTORNEY
I, the undersigned, JAMES G. ROURKE, City Attorney of
the City of Tustin, California, do hereby consent to the
destruction of the materials described in the attached
Resolution.
