"Requirement of Use Permit for Mulitiple Unit Projects Exceeding One-Story or Twenty Feet in Height when Abutting RECOMMENDATION: Adopt by Title Only and Waive First Reading of Ordinance No. 862 BACKGROUND: This ordinance was prepared with the specific and limited intent of requiring all multiple unit developments to meet the same standards for review and action by the Planning Agency as currently required for PD, condominium projects. Council has expressed concern over definitions and "how heights are measured." If any further modifications of City Code result from such concerns, it would not include these ordinance provisions. This ordinance merely establishes uniform review requirements on all multiple unit projects. Under New Business on the Planning Agency Agenda, staff has prepared a brief graphic presentation on how height measurements are conducted, the impact of grade differentials and the height restrictions of our various zoning districts. At that time additional directions as to future amendments would be appropriate. MB/mi 1 2 5 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 862 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ~NDING ARTICLE 9, CHAPTER 2 OF THE TUSTIN CITY CODE RELATIVE TO LAND USE AND ZONING The City Council of the City of Tustin, California, does hereby ordain that Article 9, Chapter 2, Part 2 of the Tustin City Code shall be and is amended as follows: Section 1. Section 9224g.1. is hereby amended to read as follows: "1. Height Limit: (a) None, except as limited herein below. (b) When a lot in the PD district abuts at any point along its property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main building shall be erected on said PD lot to a height to exceed one (1) story, and/or twenty (20) feet, whichever is more restrictive, within one hundred fifty (150) feet of said R-A, E-4 or R-1 zoned property, unless the Planning Agency shall grant a conditional use permit thereof. (c) Further, no main building shall be erected on said PD lot to a height to exceed three (3) stories, and/or fifty (50) feet, whichever is more restrictive, within three hundred (300) feet of said R-A, E-4 or R-1 zoned (developed or undeveloped) property, unless the Planning Agency shall grant a conditional use permit thereof." Section 2. Section 9225 is hereby amended by adding thereto subsection c to read as follows: "c. Maximum Height-Exception. Notwithstanding any provision to the contrary contained in this Section 9225, when a lot in the R-2 district abuts at any point along its property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main building 6 '7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 shall be erected on said R-2 lot to a height to exceed one (1) story, and/or twenty (20) feet, whichever is more re- strictive, within one hundred fifty (150) feet of said R-A, E-4 or R-1 zoned property, unless the Planning Agency shall grant a conditional use permit thereof." Section 3. Section 9226 is hereby amended by adding thereto subsection c to read as follows: "c. Maximum Height-Exception. Notwithstanding any provision to the contrary contained in this Section 9226, when a lot in the R-3 district abuts at any point along its property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main building shall be erected on said R-3 lot to a height to exceed one (1) story, and/or twenty (20) feet, whichever is more restrictive, within one hundred fifty (150) feet of said R-A, E-4 or R-1 zoned property, unless the Planning Agency shall grant a conditional use permit thereof." Section 4. Section 9228 is hereby amended by adding thereto subsection d to read as follows: "d. Maximum Height-Exception. Notwithstanding any provision to the contrary contained in this Section 9228, when a lot in the R-4 district abuts at any point along its property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main building shall be erected on said R-4 lot to a height to exceed one (1) story, and/or twenty (20) feet, whichever is more restrictive, within one hundred fifty (150) feet of said R-A, E-4 or R-1 zoned property, unless the Planning Agency shall grant a conditional use permit thereof."
