It is recommended that the City Council continue this item to the December 7, 1981 .~m~cting. At its last .m~-cting, the Planning Agency continued consideration of the amendment to its December 7, 1981 meeting. The City Council cannot adopt the proposed ordinance or a~ ~ended version until the Planning Agency submitted its reco,,,~ndation to the City Council. It is also recon~ended that the Planning Agency review the proposed amendment at its December 7 meeting through a study session approach. This will ensure that all Planning Agency viewpoints are expressed ar~ a consensus is developed before the City Council prc~-ccds with its public hearing. Staff will be prepared to suggest alternative ways of defining height limitations. ORDINANCE NO. 862 2 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, A~NDING ARTICLE 9, CHAPTER 2 OF THE TUSTIN CITY CODE RELATIVE TO LAND USE AND ZONING 5 6 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The City Council of the City of Tustin, California, does hereby ordain that Article 9, Chapter 2, Part 2 of the Tustin City Code shall be and is amended as follows: Section 1. Section 9224g.1. is hereby amended to read as follows: "1. Height Limit: (a) None, except as limited herein below. (b) When a lot in the PD district abuts at any point along its property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main building shall be erected on said PD lot to a height to exceed one (1) story, and/or twenty (20) feet, whichever is more restrictive, within one hundred fifty (150) feet of said R-A, E-4 or R-1 zoned property, unless the Planning Agency shall grant a conditional use permit thereof. (c) Further, no main building shall be erected on said PD lot to a height to exceed three (3) stories, and/or fifty (50) feet, whichever is more restrictive, within three hundred (300) feet of said R-A, E-4 or R-1 zoned (developed or undeveloped) property, unless the Planning Agency shall grant a conditional use permit thereof." Section 2. Section 9225 is hereby amended by adding thereto subsection c to read as follows: "c. Maximum Height-Exception. Notwithstanding any provision to the contrary contained in this Section 9225, when a lot in the R-2 district abuts at any point along its property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main building 1 2 4 5 6 7 8 9 10 11 12 15 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 shall be erected on said R-2 lot to a height to exceed one (1) story, and/or twenty (20) feet, whichever is more re- strictive, within one hundred fifty (150) feet of said R-A, E-4 or R-1 zoned property, unless the Planning Agency shall grant a conditional use permit thereof." Section 3. Section 9226 is hereby amended by adding thereto subsection c to read as follows: "c. Maximum Height-Exception. Section 4. Section 9228 is hereby amended by adding thereto subsection d to read as follows: "d. Maximum Height-Exception. Notwithstanding any provision to the contrary contained in this Section 9228, when a lot in the R-4 district abuts at any point along its property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main building shall be erected on said R-4 lot to a height to exceed one (1) story, and/or twenty (20) feet, whichever is more restrictive, within one hundred fifty (150) feet of said R-A, E-4 or R-1 zoned property, unless the Planning Agency shall grant a conditional use permit thereof."
