SUBJECT: Proposed Zoning Code Amendments for Residential Height Limitations
RECOMMENDED ACTION
Recommend approval by the City Council of the Zoning Code Amendments for
Residential Height Limits by the adoption of Resolution No. 2005.
BACKGROUND AND DISCUSSION:
At the October 5, 1981 meeting, the City Council directed staff to prepare a
draft ordinance to amend the maximum height provisions of the R-2, R-3, and.
R-4 districts to bring them into conformance with certain provisions of the
Planned Development District. At the October 21, 1981 meeting, the City
Council directed staff to advertise a public hearing for the formal ordinance
consideration.
The City Attorney has reviewed the proposal and has included recommended
changes in the document's format.
This ordinance, if enacted, would require use permit approval for two (2)
story multiple-family residential structures within 150 feet of any R-l, E-4
or RA property.

ORDINANCE NO. 862
AN ORDINANCE OF THE CITY OF TUSTIN,
CALIFORNIA, AJ~NDING ARTICLE 9,
CHAPTER 2 OF THE TUSTIN CITY CODE
RELATIVE TO LAND USE AND ZONING
The City Council of the City of Tustin, California, does
hereby ordain that Article 9, Chapter 2, Part 2 of the Tustin
City Code shall be and is amended as follows:
Section 1. Section 9224g.1. is hereby amended to read
as follows:
"1. Height Limit:
(a) None, except as limited herein below.
(b)
When a lot in the PD district abuts
at any point along its property lines,
or is directly across a street or alley
from, property zoned R-A, E-4 or R-1
(developed or undeveloped), no main
building shall be erected on said PD
lot to a height to exceed one (1)
story, and/or ~wenty (20) feet,
whichever is more restrictive, within
one hundred fifty (150) feet of said
R-A, E-4 or R-1 zoned property, unless
the Planning Agency shall grant a
conditional use permit thereof.
(c)
Further, no main building shall be
erected on said PD lot to a height
to exceed three (3) stories, and/or
fifty (50) feet, whichever is more
restrictive, within three hundred
(300) feet of said R-A, E-4 or R-1
zoned (developed. Or undeveloped)
property, unless the Planning Agency
shall grant a conditional use permit
thereof."
Section 2. Section 9225 is hereby amended by adding thereto
subsection c to read as follows:
"c. Maximum Height-Exception.
Notwithstanding any provision to the contrary
contained in this Section 9225, when a lot in
the R-2 district abuts at any point along its
property lines, or is directly, across a street
or alley from, property zoned R-A, E-4 or R-1
(developed or undeveloped), no main building

shall be erected on said R-2 lot to a
height to exceed one (1) story, and/or
twenty (20) feet, whichever is more re-
strictive, within one hundred fifty (150)
feet of said R-A, E-4 or R-1 zoned property,
unless the Planning Agency shall grant a
conditional use permit thereof."
Section 3. Section 9226 is hereby amended by adding
thereto subsection c to read as follows:
"c. Maximum Height-Exception.
Notwithstanding any provision to the contrary
contained in this Section 9226, when a lot in
the R-3 district abuts at any point along its
property lines, or is directly across a street
or alley from, property zoned R-A, E-4 or R-1
(developed or undeveloped), no main building
shall be erected on said R-3 lot to a height
to exceed one (1) story, and/or twenty (20)
feet, whichever is more restrictive, within-
one hundred fifty (150) feet of said R-A,
E-4 or R-1 zoned property, unless 'the Planning
Agency shall grant a conditional use permit
thereof."
Section 4. Section 9228 is hereby.amended by adding
thereto subsection d to read as follows:
"d. Maximum Height-Exception.
Notwithstanding any provision to the contrary
contained in this Section 9228, when a lot in
the R-4 district abuts at any point along its
property lines, or is directly across a street
or alley from, property zoned R-A, E-4 or R-1
(~eveloped or undeveloped), no main building
shall be erected on said R-4 lot to a height
to exceed one (1) story, and/or twenty (20)
feet, whichever is more restrictive, within
one hundred fifty (150) feet of said R-A,
E-4 or R-t zoned property, unless the Planning
Agency shall grant a conditional use permit
thereof."
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin, California, held on the day of

RESOLUTION NO. 2005
A RESOLUTION OF THE TUSTIN PLANNING AGENCY RECOMMENDING TO THE
CITY COUNCIL ADOPTION OF ORDINANCE NO. 862 , AMENDING THE
HEIGHT RESTRICTIONS IN THE MULTIPLE FAM~'[T-ffISTRICTS
The Planning Agency of the City of Tustin does hereby resolve as
follows:
1. The Planning Agency finds and determines

That the City Council directed City staff to revi. ew and draft
regulations to amend height restrictions in the multiple family
districts.
B. That a public hearing was duly called, noticed and held on said
amendments.
Ce
That the height restrictions in the Zoning Code do not
adequately protect the character of neighboring single story,
single family districts, and they should be amended.
The Planning Agency hereby recommends to the City Council that the
height limitations of the R-2, R-3, R-4 and Planned Development
(PD) Districts be amended as set forth in draft Ordinance No. 862.
PASSED and ADOPTED at a regular meeting of the Planning Agency of the
City of Tustin, held on the of , 1981.
