SUaJECT: Annexation Request - Newport South of 17th Street
A request for annexation has been submitted by 14 of the 22 property owners on
the westerly side of Newport Avenue southerly of 17th Street. This represents
63% of the property owners and 47% of the market value of the land and
improvements.
These properties are a portion of the area that has been the subject of
discussion among the property owners, SMAC, and Environmental Management Agency
in the preparation of a Specific Plan.
This request for annexation could be processed as an uninhabited annexation with
less than 12 registered voters. When approved by LAFCO, the City Council would
conduct a protest hearing. The City Council could then order the area annexed
upon a finding that protests represent less than 50% of the value of the
.territory proposed for annexation.
Land uses would remain as currently zoned by the County of Orange as
Professional and E-4 estates. Subsequent requests for change in land use would
require public hearings and approval by the City Council.
A resolution has been prepared for Council application to the Local Agency
Formation Commission requesting authority for the City to proceed with the
annexation proposal. The application would be submitted upon completion of the
final map and legal description.
RECOMMENDATION:
It is recommended that Resolution No. 81- lt9 be submitted for Council
consideration on November 2, 1981 with a request for authorization to pay
reasonable and necessary expenses to include a filing fee not to exceed $500.00
and preparation of map and legal description not to exceed $3,000.00.
