RECOMMENDED ACTION:
Staff recommends that the Planning Agency recommend to the City Council that
focus EIR 81-2 and amendments be certified as a final EIR by the adoption of
Resolution No. 2003.

BACKGROUND:
Cal Pacific Properties has filed a use permit (81-29) to construct a mixed use.
development consisting of professional offices, restaurants, financial, retail
commercial and a motion picture theater. As part of the requirements of CEQA,
an initial study questionnaire was completed and reviewed by staff.
Staff determined that an Environmental Impact Report would be required, focus-
ing on the potential environmental effects of land use and traffic. Per Sec-
tion 15012(b) of CEQA, an economic study was also presented,
A workshop was held in the Council Chambers on October 5, 1981 to discuss the
focused EIR. The staff report, minutes, comments and responses to these con-
cerns are enclosed within, and will become a part of the final EIR.
DISCUSSION:
The focused Environmental Impact Report'was prepared by Ultrasystems, Inc. for
the City of Tustin. Staff initially reviewed the document as a screen check,
with all questions and concerns incorporated into the draft EIR. This document
was distributed for the forty-five day review period. Besides the comments
received at the workshop, only the Orange County Fire Department has respond-
ed. They stated that the Department has the capacity to fight a fire in a six
story building in Tustin. They also stated that the high risk fire protection
package will reduce the need for additional manpower, but that the proposed
project will contribute to a cumulative need for future manpower and equipment.
The summary of the significant environmental effects and mitigating measures
include:
Land Use. The project would result in approximately eleven acres of
vacant land being developed for mixed commercial use. With proper use
of landscaping, architectual treatment and setbacks, the proposed land
uses can be compatible to surrounding land uses.
Traffic. The increased activity and new construction is expected to
generate a total of g,300 daily vehicle trips. Level of service for
the Newport Avenue/Main Street intersection is expected to change from
A to B; level of service for the Newport Avenue/E1Camino Real inter-
section is expected to change from B to C, and the service for the E1
Camino Real/Main Street intersection is expected to change from B to
C-D upon completion of the project. No specific mitigating measures
are required since the service level for key intersections does not
drop below the D level. However, a left-turn lane will be required on
E1 Camino Real, to Site II, and one is recommended for eastbound Sixth
Street. A similar left turn lane should be placed on Sixth Street for
eastbound traffic entering Site I. Additionally, the Engineering
Department will have final approval over any improvements required in
the public right-of-way.
Revenue/Cost Analysis. The total annual revenue impact estimate at
the completion of Phase IV is $823,204, of which $126,214 is for the
General Fund and $696,990 is for the redevelopment agency. The esti-
mated annual cost impact to the City at the completion of Phase IV is
$40,047. This results in a positive revenue/cost ratio of 20.56. The
project would result in a total of 1,731 new employees. Refer to
Table 14 on Page 17 of the Supplement to the Draft EIR 81-2.
After review from various departments, it is determined by staff that Draft
Focus-EIR 81-2 is an acceptable document and in conformance with the state law
and policies of the City Council. That mitigating measures as incorporated in
the draft EIR and amendments will bring the project to an acceptable level of
environmental impacts.
Further, staff recommends that any concerns as related to the height of the
structures be considered under the Use Permit portion of the public hearing.
The height of the structures themselves is not considered a significant envi-
ronmental impact, and therefore does not fall under the CEQA process, but as
part of the Use Permit process.

A RESOLUTION OF THE PLANNING AGENCY OF THE CITY
OF TUSTIN RECOMMENDING TO THE CITY COUNCIL THAT
DRAFT FOCUS-EIR 81-2 AND AMENDMENTS BE CERTIFIED
AS FINAL FOCUS-EIR 81-2
The Planning Agency of the City of Tustin does hereby resolve as follows:
I. The Planning Agency finds and determines as follows:

That a proper application, (Use Permit 81-29), has been filed
by Cal Pacific Properties requesting authorization to develop a
commercial project on the site fronting on Newport Avenue
between Main Street and E1Camino Real. That due to potential
significant environmental effects, a focus EIR would be
required.
B. That a Draft Focus Environmental Impact Report for the proposed
project has been prepared by Ultrasystems, Inc.

That distribution of the Draft Focus-EIR was made to interested
public and private agencies with a solicitation of comments and
evaluation.
D. That ~ public hearing was duly called, noticed and held on the
draft EIR.
That incorporated within the Draft Focus Environmental Impact
Report are the comments of the public, commissions, staff and
responsible agencies.
That the Draft EIR and amendments were prepared in compliance
with the California Environmental Quality Act, state guide-.
lines, and the policies of the City of Tustin.
That the Draft EIR and amendments have been reviewed and con-
sidered, and that mitigating measures have been incorporated
into the project that eliminate or substantially lessened the
significant environmental effects thereof as identified in the
Draft EIR and amendments.
II.
The Planning Agency does hereby recommend to the City Council that
Draft Focus-EIR 81-2 and amendments, for Use Permit 81-29 be certi-
fied as a final Focus-EIR 81-2.
