SUBJECT: AUTHORIZATICN TO ADVER2ISE FOR BIDS FOR NEN~OR2 AVENUE BIKE TRAIL
~ CURB RE~LACE~IF2 PRO3ECT
It is rec~=nded that the Tustin C~,,,~nity Rede~lcp~ent Agency, at their meeting
of Oct. 19, 1981, pass and adopt the attached resolution approving plans and
specifications for subject project and directing the Agency Secretary to advertise
for bids.
Subject project encu~asses replacing the existing failing as~alt concrete bike
trail be~m curb on Newport Avenue between Main St. and Irvine Blvd. with Portland
c~ent concrete curb. The Engineer's estimate for this project is $13,500.00.
There is presently $22,000.00 in RDA funds budgeted for this work.
The tentative schedule for this project is as follows:

A RESOLUTION OF THE ~JSTIN ~TY REDEVELOP~T ~ENCY
OF ~HE CITY OF ~3STIN, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS FOR N~PORT AV~qUE BIKE TRAIL BERM CURB
REPLACEMENT
V~EREAS, it is the intention of the Redevelopment Agency of the City of
Tustin, California to construct a concrete berm curb to replace the existing
AC berm curb on the Newport Avenue bike trail from Main Street to Irvine
Blvd., and;
V~EREAS, the City Engineer has presented plans and specifications for
9 the construction of said work;
10 NOW THEREFORE, BE IT RESOL¥~3 that the plans and specifications
presented by the City Engineer be and are hereby approved as the plans and
11 specifications for:

AVENUE BIKE TRAIL BERM CURB REPLACEMENT
13 BE IT M3RTHER RESOLVED that the Secretary is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or
14 proposals for the doing of the work specified in the aforesaid plans and
specifications which said advertisement shall be substantially in the
15 following words and figures to-wit:

17 SEALED PROPOSALS will be received at the office of the Tustin
C~,m,onity Redevelopment Agency Secretary, Tustin City Hall, 300 Centennial
18 Way, Tustin, California, until 9:00 A.M. on the 10th day of November, 1981,
at which tim~ they will be publicly opened and read, 'for performing work as

The foregoing quantities are approximate only being given as a basis for
the c~,~arison of bids, and the Tustin C~L,,~nity Redevelopment Agency does
not, expressly or by implication, agree that the actual amount of work will
correspond therewith, ~ut reserves the right to increase or decrease the
amount of any class or portion of the work or to cmit portions of the work as
may be deemed necessary or advisable by the Engineer.
Plans, specifications and proposal forms to be used for bidding on this
project can only be obtained by prospective bidders at the office of the
Agency Secretary, Tustin City Hall, 300 Centennial Way, Tustin, California,
92680, upon payment of $5.00 per set, which 8mount shall be non-refundable.
Plans and specifications will only be mailed out upon payment of $10.00
per set, which ~m~ount shall be non-refundable.
In conformance with Section 37931 of the Government Code, all bide shall
be presented under sealed cover on the proposal form provided and accompanied
by one of the following forms of bidder's security:
a. Cash
b. Cashier's check made payable to the Tustin Community Redevelopment
Agency .
c. Certified check made payable to the Tustin C~unity Redevelopment
Agency .
d. Bidder's bond executed by an accredited surety insurer, made
payable to the Tustin Cu,u,~nity Redevelopment Agency .
The sec%~rity shall be in an amount equal to at least ten percent (10%) of
the amount of the bid. A bid shall not be considered unless one of the forms
of bidder's security is enclosed therewith.
A Security Bc~d for payment of labor and materials will be required in
the amount of fifty percent (50%) of the estimated total contract price and a
Faithful Performance Bond in the amount of one hundred percent (100%) of the
estimated total contract price in the form attached to the contract
documents. Said bonds shall be issued by a Surety Cc~pany rated grade A or
better and Class IX or better by the latest edition of Best's Key Rating
Guide.
The Tustin Cu;,~nity Redevelopment Agency reserves the right to reject
any or all bids, and/or waive any informality on a bid. No bidder may
withdraw his bid for a period of thirty (30) days after the date set for the
opening thereof.
The contract will be awarded to the lowest qualified bidder.
Provisions of the State Contract Act are not applicable, and prospective
bidders will not be required to be prequalified.
Ail work to be done under the direct supervision of the City Engineer, ·
City of Tustin.
Ail work to be paid for at the unit prices bid frc~ appropriated monies.

The Tustin C~.t~mity Redevelopment Agenc%~ has obtained frc~ the Director
of Industrial Relations the general prevailing rate of per diem wages and
the general prevailing rate for legal holiday and overtime ~ork in the
locality in whid~ the work is to be performed for ead~ craft or type of
work needed and a copy of the same is on file in the office of the Agency
Secretary.
Not less than said prevailing rates shall be paid to workers employed on
this public works contract as required by Labor Code Sections 1771 and 1774
of the State of California.
