Proposed Zoning Code Amendments for Residential Height Limitations
RECOMMENDED ACTION:
Direct staff to notice a public hearing for the formal consideration of the
draft ordinance at the next meeting.
BACKGROUND AND DISCUSSION:
At the October 5, 1981 meeting, the City Council directed staff to prepare a
draft ordinance to amend the maximum height provisions of the R-2, R-3, and R-4
districts to bring them into conformance with certain provisions of the Planned
Development District.
This ordinance, if enacted, would require use permit approval for two (2) story
multiple-family residential structures within 150 feet of any Ri1, E-4 or RA
property.
This document will be forwarded to the City Attorney's office for review prior
to the next meeting.

ORDINANCE
AN ORDINANCE OF THE CITY OF TUSTIN,
CALIFORNIA, AJ~ENDING ARTICLE 9, CHAPTER 2
OF THE TUSTIN CIl~f CODE RELATIVE TO
LAND USE AND ZONING
The City Council of the City of Tustin, California, does hereby
ordain that Article g, Chapter shall be amended as follows:
A) Section 9224g.1. is hereby amended to read as follows:
(a) None, except as limited herein below.
(b)
When a lot in the R-2, R-3, R-4 or PD districts abut at
any point along its property lines, or is directly across
a street or alley from, property zoned R-A, E-4 or R-1
(developed or undeveloped), no main building shall be
erected on said R-2, R;3, R-4 or PD lots to a height to
exceed one (1) story, and/or twenty (20) feet whichever is
more restrictive, within one hundred fifty (150) feet of
said zoned property, unless the Planning Agency shall
grant a conditional use permit thereof.
(c)
Further, no main building shall be erected on said PD lot
to a height to exceed three (3) stories, and/or fifty (50)
feet, whichever is the more restrictive, within three
(300) feet of said R-A, E-4 or R-1 zoned (developed or
undeveloped) property, unless the Planning Agency shall
grant a conditional use permit thereof.
B) Section 9225al(a) is hereby amended to read as follows:
Maximum Height: As specified in the R-1 District except
as limited in Section 9224g.i.(b) of the Tustin City Code,
Planned Development District.
C) Section 9225a2(a) is hereby amended to read as follows:
Maximum Height: 35 feet, except as limited in Section
9224g.l.(b) of the Tustin City Code, Planned Development
District.
D) Section 9225bi(a) is hereby amended to read as follows:
Maximum Height: 35 feet, except as limited in Section
9224g.i.(b) of the Tustin City Code, Planned Development
District.

E) Section 9225b2(a) is hereby amended as follows:
Maximum Height: 30 feet except as limited in Section
92249.1.(b) of the Tustin City Code, Planned Development
District.
F) Section 9226al(a) is hereby amended to read as follows:
Maximum Height: 40 feet except as limited in Section
92249.1.(b) of the Tustin City Code, Planned Development
District.
G) Section 9226a2(a) is hereby amended to read as follows:
Maximum Height: 40 feet, except as limited in Section

District.

District.
K) Section 9226bS(a) is hereby amended to read as follows:
Maximum Height: 40 feet except as limited in Section
92249.1.(b) of the Tustin City Code, Planned Development
District.
L) Section 9228c.1. is hereby amended to read as follows:
Maximum Height: 2 stories or 35 feet, except as limited in
Section 92249.1.{b) of the Tustin City Code, Planned
Development District.
