SUBJECT: Environmental Impact Report 81-2
Applicant: Cal Pacific Properties
Location: Newport Avenue, between Main Street and E1 Camino Real
DISCUSSION:
As a requirement of the California Environmental Quality Act, all environmental
impact reports shall be certified by the decision-making body of the Lead
Agency.
Resolution No. 81-117 would certify Focused EIR 81-2, which was prepared for
Use Permit 81-29, as a Final Environmental Impact Report. Resolution No. 2003
was passed by the Planning Agency recommending to the City Council that the EIR
be certified as complete.
Staff recommends to the City Council that Draft Focused EIR 81-2, plus amend-
ments, is an acceptable document and in conformance with the California Envi-
ronmental Quality Act, state guidelines and the policies of the City Council.
It has been determined by staff, after review, that mitigating measures can be
incorporated into the project that will eliminate or substantially lessen the
significant environmental effects.
RECOMMENDATION:
Staff recommends that the City Council certify Draft Focused EIR 81-2, plus
amendments as a Final Focused EIR, per the recommendation of the Planning
Agency.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN CERTIFYING DRAFT FOCUS-EIR
81-2 AND AMENDMENTS FOR USE PERMIT 81-29
(CAL PACIFIC PROPERTIES) AS FINAL FOCUS-EIR 81-2
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:

That a proper application, (Use Permit 81-29), has been filed
by Cal Pacific Properties requesting authorization to develop a
commercial project on the site fronting on Newport Avenue
between Main Street and E1Camino Real. That due to potential
significant environmental effects, a focus EIR would be
required.

That a Draft Focus Environmental Impact Report for the-proposed
project has been prepared by Ultrasystems, Inc.
That distribution of the Draft Focus-EIR was made to interested
public and private agencies with a solicitation of comments and
evaluation.
That a public hearing was duly called, noticed and held on the
draft EIR.

That incorporated within the Draft Focus Environmental Impact
Report are the comments of the public, commissions, staff and
responsible agencies.
That the Draft EIR and amendments were prepared in compliance
with the California Environmental Quality Act, state guide-
lines, and the policies of the City of Tustin.

That the Draft EIR and amendments have been reviewed and con-
sidered, and that mitigating measures have been incorporated
into the project that eliminate or substantially lessened the
significant environmental effects thereof as identified in the
Draft EIR and amendments.

The City Council approves the findings and recommendations con-
tained in the City of Tustin Planning Agency Resolution No.
2003, which recommended to the City Council that Draft Focus-
EIR 81-2 plus amendments, be certified as a final Focus-EIR
81-2.
The City Council of the City of Tustin does hereby certify Draft
Focus-EIR 81-2 and amendments, for Use Permit 81-29 as a final
Focus-EIR 81-2.
