BACKGROUND AND DISCUSSION:
The Tustin Heights Shopping Center was developed and built under County stan-
dards and subsequently annexed into the City in January of lg66. The owner is
now requesting authorization to bring the center up to City development stan-
dards. Staff views this application as a very positive move for the center and
the City.
The center is currently undergoing rejuvenation with improvements to the
parking lot, landscaping, signing, perimeter and block wall. Most of the old
landscape materials have been removed and will be replaced acording to the
submitted plan. Staff will inspect the landscaping to insure that the new
landscaping materials will not hinder sight visibility for motorists as had
been the case previously.
The submitted plan indicates that landscaping islands will be installed along
the perimeter of the property next to Irvine Blvd. Presently, new sidewalks
are being installed in front of the stores which will contain new tree wells
and some low plant materials.
The parking lot will be restriped at a later date to include some compact car
spaces. This plan has not been received by the department, but will be
reviewed and approved according to City standards. One positive feature of the
proposed parking lot design will be the closure of the drive isle intersection
immediately opposite Old Irvine Boulevard. This modification should alleviate
the traffic congestion at this entrance.
The owner is currently seeking the cooperation with the tenants to upgrade the
signing to comply with the enclosed master sign plan which now conforms to our
sign code. Thses signs will not only conform to code, but give the whole
center an updated "look" and improve the architectural elevations of the
building. At present the major tenants wish to retain the center signing which

does not conform to the Sign Code (Ralph's and Builder's Emporium). At such
time that a major expansion or modification of either use is initiated, it is
recommended that the center sign be brought into conformance with the City of
Tustin Sign Code.
The owner has also stated that they will replace a grape stake fence with a
6'8" block wall at the southeasterly portion of the center as shown on the
enclosed plan.
RECOMMENDED ACTION:
Approve Use Permit 81-28 by the adoption of Resolution No. 2002.

RESOLUTION NO. 2002
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF
TUSTIN GRANTING A USE PERMIT ON APPLICATION U.P. 81-28
FOR RENOVATION OF THE TUSTIN HEIGHTS SHOPPING CENTER.
The Planning Agency of the City of Tustin does hereby resolve
as follows:
1. The Planning Agency finds and determines as follows:

That a proper application (U.P. 81-28) was filed on
behalf of Rosenberg Real Estate Equity Fund IV for a
Use Permit to allow construction and renovation of
Tustin Heights Shopping Center.
b. That a public hearing was duly called, noticed and held
on said application.

That establishment, maintenance and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety,
morals, comfort or general welfare of the persons
residing or working in the neighborhood of such
proposed use, evidenced by the following findings:
That the proposed use is a substantial reduction
in the nonconformity of existing signing at the
subject site.

That the proposal has been made in conjunction
with an improvement program for the shopping
center and is in substantial conformance with
development guidelines as adopted by the City
Council.

That the establishment, maintenance and operation of
the use applied for will not be injurious or detri-
mental to the property and improvements in the neigh-
borhood of the subject property, nor to the general
welfare of the City of Tustin, and should be granted.

Proposed development shall be in accordance with the
development policies adopted by the City Council, Uni-
form Building Codes as administered by the Building
Official, Fire Code as administered by the Fire Chief,
and street improvement requirements as administered by
the City Engineer.
f. Final develOpment plans shall require the review and
approval of the Community Development Director.
That the project is categorically exempt from the
requirements of the California Environmental Quality
Act.

The Planning Agency hereby grants a Use Permit, as applied
for, to allow the renovation of the Tustin Heights Shopping
Center subject to the following conditions:
a. That all tenant signs shall conform to the master sign
plan, as submitted, subject to a sign permit.
That no additional individual free standing signs are
authorized for this site until all existing non-
conforming signs are removed (Ralph's, Guild, Builder's
Emporium).
c. Installation of a 6'8" block wall in the easterly
property line.
d. That landscape construction plans shall be submitted
and approved by staff prior to permit issuance. ~
e. Submission of final parking layout for staff review and
approval.
