RECOMMENDED ACTION:
Adopt Resolution No. 81-110 which approves the City's participation in the
Housing & Community Development block grant program.
BACKGROUND DISCUSSION:
On September 16, 1981, the City Council approved an action to sign the Housing
& Community Development agreement with the County of Orange.
The complete package is now ready for submission to the County and requires
Council approval. The package contains the following documents:
1. Agreement
2. Grant Application
3. Housing Assistance Plan
4. Assurances
Part 3 of the package is the Housing Assistance plan which contains figures
provided by the Southern California Association of Governments. HUD recognizes
these figures as to needs for low and moderate income persons. These figures
in no way reflect upon how many low and moderate income persons will actually
make use of the grants.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
APPROVING THE CITY'S PARTICIPATION IN THE HOUSING
AND COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAm4 WITH
THE COUNTY OF ORANGE
WHEREAS,
it is the intent of the City of Tustin to participate in the
filing of an application with the County of Orange for a grant
authorized under the Housing and Community Development Act of
1974; and
WHEREAS,
the Housing and Community Development Act of 1974 authorizes
cities under 50,000 population to enter into cooperation
agreements with the county in which they are located for the
purpose of undertaking essential community development
activities; and
WHEREAS,
the Federal government requires participating cities to provide
a statement of assurances that the funds will be obtained and
utiliz6d pursuant to Federal law and policy; and
WHEREAS,
it is necessa~ that the City adopt a Housing Assistance Plan
before filing an application under the Housing and Community-
Development Act of 1974; and
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby adopt
the Cooperation Agreement, Statement of Assurances, the Housing
Assistance Plan and Grant Proposal.
PASSED AND ADOPTED by the City Council of the City of Tustin,
California, at a regular meeting held on the 5th day of October 1981.

COOPERATION AGREEMENT
THIS AGREEMENT is entered into this
day of

corporation, hereinafter
referred to as CITY,
AND
COUNTY OF ORANGE, a political
subdivision of the State of
California and recognized Urban.
County under the Federal Housing
and Community Development Act
of 1974 & 1977, hereinafter
referred to as COUNTY.
%{HEREAS, Title I of the Housing and Community Development
Acts of 1974 and 1977, hereinafter referred to as ACT, makes
available to cities under 50,000 population and the unincorpor-
ated area of the County of Orange certain sums to be used for a

WHEREAS, said ACT authorizes such cities and said COUNTY tO
enter into cooperation agreements in order to cooperate in under-
taking or assisting in undertaking, essential community develop-
ment and housing assistance activities, specifically urban renewal
and publicly assisted housing;
NOW, THEREFORE, the parties agree as follows:
1. This Agreement shall constitute a cooperation agreement
between the parties within the meaning of Section 102(a)(b) of
the ACT. The parties agree to cooperate in the undertaking, or
assisting in undertaking, community development and lower income
housing activities, specifically urban renewal and publicly
assisted housing.

2. COUNTY shall be responsible for the preparation, adoption
and submission of an Urban County Application to the Department of
Housing and Urban Development, hereinafter referred to as "HUD".
In the preparation of said application, COUNTY shall give due con-
sideration to CITY's analysis of community development needs and
proposed activities.
3. CITY shall comply with the COUNTY's community development
program and the Housing Assistance Plan, and all laws, regulations
and policies applicable to said grant.
4. Both COUNTY and CITY agree to take all required activities
to comply with the provisions of Title VI of the Civil Rights Act
of 1964, Title VIII of the Civil Rights Act of 1968, Section 109
of the Housing and Urban Development Act of 1968 and other civil
rights laws.
5. In the event COUNTY's Urban County application is approved
by HUD, COUNTY shall contract with the CITY to utilize any such
grant funds received from HUD which are attributable to activities
conducted by CITY, unless another form of distribution is required
by HUD.
6. This Agreement shall be for the three year program period
covering the 8th, 9th, and 10th year Housing and Community Develop-
ment Block Grant applications. In no event shall this Agreement be
terminated before this three year period.
7. The activities to be undertaken during the term of this
Agreement will be chosen by CITY from the following listing:
a. Acquisition of Real Property
b. Public Works, Facilities, Site Improvements
c. Code Enforcement
d. Clearance, Demolition, Rehabilitation
e. Rehabilitation Loans and Grants

8. a. CITY shall indemnify, hold harmless and defend
COUNTY, its officers, agents and employees against all liability,
claims., losses, demands and actions for injury to or death of
persons or damage to property arising out of or alleged to arise
out or in consequence of this Agreement, provided such liability,
claims, demands, losses or actions are claimed to be due to the
acts or omissions of CITY, its officers, agents or employees in
the performance of this Agreement, including any activities con-
ducted by CITY under its application.
b. In addition, CITY shall indemnify and hold harmless
i COUNTY against any liability, claims, losses, demands, and actions
incurred by COUNTY as a result of a determination by HUD that
~ activities undertaken under CITY's application failed to comply
with, any laws, regulations, or policies applicable thereto or
that any funds forwarded to CITY under this Agreement were im-
properly expended.
c. The provisions of paragraphs 1, 3, 4, 5, 6 and 7 of
Section 2778 of the California Civil Code, as said section exists
on the effective date of this Agreement, shall be applicable to
the above indemnification provisions. Transmittal to CITY of any
pleadings served upon COUNTY shall be deemed to be a request to
defend.

9. a. COUNTY shall indemnify, hold harmless and defend

'~ The population of the C±ty of Tustin is 37,264. The City has been
.e growing at an annual rate of .07% due to annexations and small
7 residential construction.
The economic conditions of the City are in a growth rate. Indus-
trial and retail activities are inclining every year. Business
license acti'vity has been in a steady incline for all licenses.
Last year the number of demolitions of residential strDctures was
12 and the number of new residential permits was 45. The City has
1,920 acres of undeveloped property in residential zones which is
currently in' the a~riculture preserve. ' This land will not be
develgped until the agriculture preserve status is removed. O~her
undeveloped residential land in the City limits totals only 7
acres.

A. Neighborhood revitalization needs

The City of Tustin has several areas where housing rehabili-
tation is urgently needed. These areas are identified speci-
fically on the enclosed map. The first area is called the
Old Town Tustin area and is identified as part of Area Tract
755.01. Seventy-five percent of the structures were built
prior to 1945. According to housing statistics, the area
has a population which contains a significant concentration
of low- and moderate-income persons, which includes senior
citizens, with some substandard and deteriorated housing.
Some public improvements were constructed with HCD monies in
the 1970's which included curbs, gutters, s'idewalks and a
storm drain.
The second area is known as the "Tustin Islands" which were
annexed to the City in December ~f 1980. These islands are
part of Census Tract 755.02 and 755.03 and are identified on
the enclosed map. According to statistics, these target
island areas contain a significant concentration of low- and
moderate~income persons (including senior citizens) with
some substandard and deteriorated housing stock. The one
island known as the "B" Street-Mitchell Island is in need of
public works improvements to include street, curbs, gutters,
sidewalks and lighting. The City of Tustin is proposing to
fund the cost of the storm drain needs in this area.
B. Community-wide housing needs
In order to increase the choice and availability of housing
for low- and moderate-income persons and to provide fair
housing opportunities, the City of Tustin has been active in

helping to provide the following programs:
1. Tustin Gardens - 100 units for senior citizens (Section 8
program)
2. City participation in the Orange County Housing Authority.
3. Former participation in HCDA program
4. Orange Garden Apartments (236 Housing Program) for renters
assistance.
5. Ranch San Juan Conversion providing Co-ownership program
(50% of units for 1Ow and moderate income persons).
6. Warmington Condominium Project on southerly terminis of
Newport Avenue.
35% of units will be priced for persons with 80%
to 120% of median income.
C. Community-wide needs for public facilities and improvements
It appears that the greatest need for public facilities in the
City of Tustin center around the senior citizen populationl A
Study was completed by the Community Services Department and is
attached for information. This study brought out the fact that
the number one priority item of concern is solving the housing
shortage for the elderly.
D. Economic development is healthy and needs no funding
City funds are used to support the infrastructure.

Tustin proposes to provide iow interest loans to iow/moderate
income owner occupants of single-family residences in order to
improve and preserve existing housing stock. This will encour-
age the preservation of existing affordable housing in the
target areas (Census Tracts ~755.01, 755.02, 755.03).
In addition, the public iDfrastructure that directly serves
these affordable housing ~nits is proposed to be improved to
directly benefit the low/moderate income families.

The City of Tustin will u~ilize CDBG funds to initiate a Neigh:-.
borhood Housing Rehabilitation program in the City of Tustin's
target area. The project! includes: a rehabilitation loan
program for senior citizens and low and moderate-income house-
holds to prevent blighting conditions of residential structures
and mobike homes. The loan.program will include low interest
loans, deferred payment l~ans and grants to low- and moderate-

mum feasible priority to activities which will benefit l(n~- and moderate-income
families or aid in the prevention br elimination of slums or blight.
[The requirement for this certification will not preclude the Secretary from
approving an application where th~ applicant certifies, and the Secretary deter-
mines, that all or part of the Co~.munity Development Program activities are
designed to meet other community development ne~ds ]aving a particular urgency
as specifically explained in the application in accordance with ~570.302(f).]
(g) It will comply with the regulations, policies, guidelines and reguire-
meats of OMB Circular NO. A-102, Rievised, and Fede['al Hanagement Circular 74-4
as they relate to the application, acceptance, and use of Federal funds under
24 CFR 570. ~
ih) It will administer and enfDrce the labor standards reouirements set forth
in 24 CFR 570.605 and HUD regulatibns issued to implement suc~ requiremenks.
ii) It will comply with all re~6irements imposed by HUD concerning special
requirements of law, program requiirements, and other administrative requirements,
approved in accordance with OMB Circular No. A-102, Revised.
(j) It will comply with the prpvisions of E×ecutive O~der ]1296, relating to
evaluation of flood hazards and Executive Order ll~S8 relating to the prevention,
control, and abatement of water pollution.
(k) It will reouire every building or faci]ity (other than a privately owned
residential structure) designed, cDnstructed, or ~ltercd with funds provided
u~der 24 CFR 570 to comply with the "American Standard Specifications for Naking
Buildings and Facilities Accessibl~ to, and Usable by, the Physically HandicaFp-
ed," Number A-117.1-1~ 1971, subject to the exceptions contained in 41 CFR 101-
19.604. The applicant will be responsible for col]dtlct[~...q ~nspections to [nsure
compliance with these specificatioQs by the con,ratter.
(1) It will comply with: i
(1) 'Title VI of the Civil Riqh~s Act of 1964 (Pub. L. 88-352)~ and the regu-
lations issued pursuant thereto (2~ CF}~ Part 1), which provides ~hat no person
in the United States shall on %he 9rounds of race, color, or national or[gin, be
excluded from participation in, beidenied, the benefits of, or be otherwise sub-
jected to discrimination under any~proqram or oct iv[ty for which the applicant

(4) Executive Order 11063 ~n equal o[~?ortunity in housing and nondiscrimina-
tion ill the sale or rental of housing built with Federal assistance.
(5) Executive Order 11246, iand the regulations issued pursuant thereto (24
CFR Part 130 and 41 CFR Chapte~ 60), and Section 4(b) of the Grant Agreement,
which provides that no person shall be discriminated against on the basis of race,
color, religion, sex or national origin in all phases of employment during the
performance of Federal or federally assisted construction contracts. Contractors
and subcontractors on Federal and federally assisted construction contracts shall
take affirmative action to insure fair treatment in employment, upgrading, demo-
tion, or transfer; recruitment!or recruitment advertising; layoff or termination,
fates of pay or other forms of !compensation and selection for training and
apprenticeship.
(m) It will comply with SeCtion 3 of the He,]sing and Urban Development Act of
1968, as amended, requiring that to the greatest extent feasible opportunities
for training and employment belgiven to lower-income residents of the project
area and contracts for work in connection with the project be awarded to eligible
business concerns which are located in, or owned in substantial part by, persons
residiDg in the area of the prgject.
(n) It will:
(1) To the greatest extentlpracticable under State law, comply with Sections
301 and 302 of Title III IUnifgrm Real Property Acquisition Policy) of the Uni-
form Relocation Assistance and!~eal Property Acquisition Policies Act of 1970 and
will comply with Sections 303 ~,d 304 of Title III, and HUD implementing instruc-
tions at 24 CFR Part 42; and
{2) Info[m affected Derson~ of their rights and of the acquisition policies
and procedures set forth in the re~ulatiens ~t 24 CFR Part 42 and §570.602(b).
(o) It will:
(1) Comply with Title II (~:niform Pelocstio~ Assistance) of the Uniform Relo-
cation Assistance and Real Property AcGui$ition Policies Act of 1970 and HUD
implementing regulations at 24iCF~ Part 42 and ~570.602(a);
(2) Provide relocation pay~:ents and offer relocation assistance as described
in Section 205 of the Uniform Relocation Assistance Act to all persons displaced
as a result of acquisition of ~eal property fnr an activity assisted under the
Community Development Block Grant program. Such payments and assistance shall be
provided in a fair and consistent and equitable manner that insures that the
relocation process does not result in different or separate treatment of such
persons on account of race, color, religion, national origin, sex, or source of
income;
(3) Assure that, within a ~easonable [~eriod of time prior to displacement,
comparable decent, s~fe and sanitary replacement dwellings will be available to
all displaced families and individuals omi thaL the [angc of choices available

(4) Inform affected persons of the relocotion assistance, policies and proce-

(r) It will give HUD and tho Comptroller General throuqh any authorized
representatives access to and th~ right to examine all records, books, papers~ o~
documents related to the qrant.
(s) It will insure that the facilities unde~ its ownership, lease or supervi-
sion which shall be utilized in ~he accomp]ish{nent of the program are not listed
on the Environmental Protection Ageacy's (EPA) list of Violating Facilities and
that it will notify IIUD of the r~ceipt of any communication from the Director of
the EPA Office of Federal Activin. ica indicating that a [acility to be used in the
project is under consideration for listinU by ti~? EPA.
(t) It will comply with the flood insuranc~ purchase requirements of Section
102(a) of the Flood Disaste~ Pro~ection Act of 1973. Pub. L. 93-234, 87 Stat.
975, approved December 31, 1973. Section 103(a) re(;uired, on and after Ma~ch 2,
1974, the purchase of flood insurance in communities where such insurance is
available as a condition for the receipt of ~]ny Federal ~.inancial assistance for
construction or acguisitioa purposes for use iii any area, that has been identi-
fied by the Secretary of the Department of Housing and Urban Development as an
area having special flood hazardg. The phra?.e "Federal financial assistance"
includes ~ny form of loan, g~ant~ quaranty, insurance payment, rebate, subsidy,
disaster assistance loan or gran~, or an}, other form of direct or indirect
Federal assistance.
(u) It will, in connection with its pe~form~nce of environmental assessments
under the National Environmental !Policy Act o£ 1969, comply with Section 106 of
tile National Historic PreservatiOn Act Of 1966 (16 U.S.C. 470), Executive Order
11593, and the P~eservation of A~cheological an<~ Historical Data Act of 1966 (16
U.S.C. 469a-1, et. sea.) by:
(1) Consulting with the State Historic P~ei~crvation Officer to'identify
~roperties listed in or eligiblelfor inclusion iii %he National Register of His-
toric Places that are subject to!a(]verse ef£ects ([~ec 36 CFR Pact 800.8) by the
proposed activity, and i
(2) complying with all requirements established by HUD to avoid or mitigate
adverse effects upon such properties.
