It is reco.,~anded that by Minute !Order the City Council authorize Worker's
Compensation claim settlements for Mr. Kenneth Barton in the amount of
$14,752 and Mr. Fred Kras~o in the amount of $26,500.
DISCUSSICN:
The City Council has previously given direction to Staff with regard to
negotiating the settlement of the above claims. Both individuals are
former Tustin Police Officers who incurred job related disabilities. Each
individual subsequently pursued the claim before a Worker's Compensation
Judge and, as a result, the City iatte~pted to negotiate settlement of those
claims.
The reconl~ended awards are based upon the nature and severity of their job
related disabilities and standardi rating tables (whidu convert to monetary
amounts) promulgated by the State'iWorker's Compensation Fund.
Mr. Krasco's award of $26,500 is a Compromise and R~lease which means that
for purposes of Worker's Compensa[ion, he cannot file any additional claims
against the City. Mr. Barton's award of $14,752 is a Stipulated Award
which means that the City could pQtentially be liable for future medical
costs associated with his job related disability.
