EL CAMINO REAL LS~)E~ UTILITY DISTRICT NO. 5
~TION:
That the Tustin Community Redevelopment Agency, at their meeting of September 21,
1981, adopt the attached resolution accepting said work and authorizing the
filing of the Notice of C~,~letion.
Assuming no claims or stop payment notices are filed within 30 days of the date of
recordation of the Notice of C~letion, it is further rec~u,ended that the
Redevelopment Agency authorize payment of the final 10% retention amount
($54,350.00) at that time. This ~mount together with previous payments of
$489,152.70 represents 100% of the contract work c~L.pleted to date. These amounts
do not include the $6,000.00 of unoa,~leted work.
BACKGROUND:
The subject project, consisting of conduit and structures for electrical and
telephone facilities within the E1 Camino Real Underground Utility District No. 5,
has ~cn completed by the contractor, Pacific Pipeline Construction Co., with the
exception of approximately 255 L.F. of Telephone Co. conduit. The Telephone Co.
is still in the process of obtaining an easement for this remaining work and it is
estimated that the easement acquisition will be resolved by mid-October.
Pacific Pipeline Co. has requested that the project be accepted by the*
Redevelopment Agency for the work that has been completed, so as to e~mL~nce the
30-day lien period, and they have agreed by letter to u~lete the remaining work
at the original unit prices contained in the contract. The estimated cost of the
remaining work is $6,000.00. This delay is no fault of the contractor, but. has
originated from the Telephone Co~0any's failure to obtain the necessary easements.
The preliminary contract amount based on estimated quantities was $530,945.00.
The final contract amount based on as-built quantities completed to date is
$543,503.00 plus the estimated cost of $6,000.00 for an overrun of $18,558.00, or
3.5%.
Attached is a resolution of acceptance for said work and authorization for
recordation of the Notice of Completion.

A RESOLUTION OF THE TUSTIN COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN
ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF
COMPLETION
WHEREAS, Pacific Pipeline Construction Co. having a
contract with the Tustin Community Redevelopment Agency to
construct the hereinafter described public work and improvement;
and
WHEREAS, the City Engineer has duly certified to the
construction and completion of said public improvement
hereinafter mentioned in a manner satisfactory to the members of
the Tustin Community Redevelopment Agency of the City of Tustin;
and
WHEREAS, the Tustin Community Redevelopment Agency finds
that said contractor has completed said public improvement
hereinafter more particularly described in accordance with the
provisions of the contract documents and the notice of
completion and acceptance of said public work and improvement
should be filed and payment of the balance due said contract
authorized in accordance with the contract documents.
NOW, THEREFORE, BE IT RESOLVED by the Tustin Community
Redevelopment Agency of the City of Tustin that said pubic work
and improvement be, and the same is hereby accepted. Said
public work and improvement is more particularly described as
follows:
Placement of conduit and structures for underground
electrical and telephone facilities within the E1 Camino
Real Underground Utility District No. 5.
AND BE IT FURTHER RESOLVED that the City Engineer of the
City of Tustin be, and is hereby authorized to execute and file
a notice of completion and acceptance of said public work and
improvement described herein as required by law.
