SUBJECT: UNIFIED oRANGE COUNTY - CITIES EMERGENCY MANAGEMENT AGREEMENT
RECOMMENDATION:
It is recommended that the City Council approve the attached
Unified Orange~County-Cities Emergency Management Agreement.
BACIfGROUND:
Upon the recommendation of the Blue Ribbon Committee on
Emergency Preparedness and Civil Defense, and the approval of
the Board of Supervisors, the cities in Orange County, in con-
junction with the County of Orange, have been-meeting monthly
in order to improve emergency preparedness coordination among
these jurisdictions. The attached proposed new Unified Agreement
is a product of these meetings.
DISCUSSION:
The new Unified Agreement has been revised and intends to
replace the .existing Unified Orange County-Cities Disaster
Agreement. .Thisproposed agreement was unanimously approved
by the County Counsel and the Board of Supervisors.
This agreement has been reviewed and approved bY the City Attorney
and Interim City Manager.
FISCAL IMPACT:
There is no cost associated with this agreement.

UNIFIED ORANGE COUNTY-CITIES
EMERGENCY MANAGEMENT AGREEMENT
THIS AGREEMENT is entered into this [ day of
1981, which date is enumerated for purpose of reference y and
6 between the COUNTY OF ORANGE, hereafter referred to as "COUNTY," and
7 the cities within Orange County which are signatories hereto; hereafter
8 referred to as "CITY" or "CITIES,"
W I T N E.S S E T H:
WHEREAS, itis the intent of the parties hereto to coordinate their
preparedness and 'response efforts for the purpose of preserving the
12 safety of persons and property from the effects of natural, man-made,
13 or war-caused disasters, hereafter referred to as "emergencies."
NOW, THEREFORE, the parties hereto agree as follows:
A. EXISTING AGREEMENTS: Nothing ~contained in this Agreement shall
be construed as repealing or modifying any existing agreements, including
mutual aid agreements, except this Agreement repeals the existing

]9 B. LOCAL AUTHORITY: In the event of an actual or threatened
20 emergency, COUNTY and each CITY shall retain the authority provided
· -21 for by law respecting its jurisdiction.
C. COUNTY SERVICES: COUNTY will provide the following services

Upon request by CITY, assist in the preparation, development
and support of all aspects of an emergency management pro-
gram for that CITY.
P~epare and develop an emergency management program which
shall provide for the needs of the unincorporated areas of

the COUNTY, and will take into account and be coordinated
with the needs of CITIES in the event of an emergency.
3. Provide assistance during emergency incidents:
a. When confined to one CITY, COUNTY will, if requested,
offer assistance within the limits of its capabilities
and will, if requested, coordinate assistance furnished
by other CITIES.
b. When affecting an area greater than one CITY, COUNTY
will, if requested, offer assistance within the limits
of its capabilities and will, if requested, direct and
coOrdinate the assistance furnished by other CITIES.
c. Notwithstanding any of the above, fire and law enforce-
ment assistance shall be provided by COUNTY pursuant to
applicable mutual aid agreements.
4. Maintain a current resource listing of the facilities,
equipment and supplies available in the County for use in
the event of an emergency.
5. Provide technical assistance in obtaining any federal or
State funds which may become available to CITIES for
emergency purposes.
6. Provide technical 'assistance in the acquisition by CITIES
of surplus and excess government property.
THE CITIES SH~T.I.:
1. Accept primary responsibility for the development within
each CITY of an emergency management program which shall be
compatible with, and complementary to, the Countywide
emergency management program.
2. Promote cooperation among CITIES and the COUNTY in order to

improve the overall Countywide emergency management program.
3. Assure training within their respective CITIES.
E. COORDINATION: It shall be the responsibility of the Orange
County Emergency Management Division to coordinate the efforts of the
parties .to this Agreement for the accomplishment of its purposes.
F. ORGANIZATION: There is hereby established the Orange County-
Cities Emergency Management Organization, hereafter referred to as
7Organization."
1. Membership in the Organization shall consist of COUNTY and
all CITIES within the County which are signatories to this
Agreement.
2. The Manager, Rmergency Management Division shall be ~e
COUNTY representative member, and shall provide clerical
support for the Organization.
3. A representative from each CITY shall be appointed, in
writing, by the City Manager/Administrator of that CITY.
4. Ex officio representatives from other public and private
agencies may actively participate as non-voting members
at the Organization's meetings and events.
5. Official action of the Organization requires a majority
vote of the membership. Each member shall have one vote.
6. Officers of the Organization and line of succession shall be:
President, First Vice President, and Second Vice President.
7. Officers of the Organization shall be elected at the first
meeting to be conducted after the effective date of this
Agreement, and annually thereafter.
8. The purposes of the Organization include the following:
a. Provide a forum for discussion and exchange of ideas

that are of mutual concern to some or all jurisdictions·
~ 2 b. Identify and examine areas of conu,on concern.and
3 coordinate the development of appropriate pians and
4 programs.
5 c. Assist in the coordination of an annual training exer-
6 cise which will be aimed at strengthening a ~pecific
7 aspect of the CITY-COUNTY disaster response relationship.
8 d. Encourage plans and programs leading toward an integrated
9 Countywide preparedness for emergencies.
.... lO e. Promote public education and individual emergency
11 preparedness within, the COUNTY and CITIES.
.... 12 f. Review legislation impacting emergency plans and pro-
grams and propose concepts for new legislation.
g. Provide technical advice to any requesting member
jurisdiction·
h. Review proposals of emergency mutual aid plans and
agreements and recommend further review and approval
of such proposals to member jurisdictions.
9. During calendar year 1981, the Organization shall meet
__20 monthly. Thereafter, regular meetings shall be held
21 quarterly. In addition, special meetings may be called by
22 the President.
23 10. The Organization has no authority to bind the COUNTY or any
24 CITY to any financial arrangement.
G. EFFECTIVE DATE: This Agreement shall take effect when executed
by COUNTY and a majority of the Cities in Orange County. Thereafter, any
City in Orange County may become a party hereto by executing this Agree-
ment.
H. WITHDRAWAL: Any party may withdraw from this Agreement by
written notice to the Board of Supervisors and the President Qf the
Organization. Said notice shall be given 30 days before withdrawal from
this Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement.
