2 AN ORDINANCE. OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE
3 96-002 AMENDING SUBSECTION 4 OF SECTION
3.7.3.C OF THE EAST TUSTIN SPECIFIC PLAN
4 RELATED TO SETBACK STANDARDS IN THE
NEIGHBORHOOD COMMERCIAL DISTRICT FOR SINGLE-
5 STORY DEVELOPMENTS.
6 The City Council of the City of Tustin does hereby ordain
as follows:

Section 1 Findinqs.

The City Council finds and determines as follows:

A. That a proper application, ZC 96-002, has been
10 filed by Sanderson J. Ray Development Co. to
amend the setback standards of the
11 Neighborhood Commercial District of the East
Tustin Specific Plan (ETSP) for single-story
12 developments located adjacent to residential
developments.

B. That a public hearing was duly noticed, called
14 and held on said application on February 10,
1997 by the Planning Commission and February
15 18, 1997 by the City Council.
16 C. That the project is covered by a previously
certified Final Environmental Impact Report
17 for the East Tustin Specific Plan which serves
as a Program EIR for the proposed project.

D. PropOsed Zone Change 96-002 would provide
19 development standards that will encourage new
construction to be physically integrated and
20 compatible with adjoining residential areas.
21 E. The land use intensity of development on the
affected sites would not be increased over the
22 current land use designation when considered
as a whole.

F. Proposed Zone Change 96-002 would be
24 .consistent with the policies of the General
Plan Land Use Element which identifies the
25 ~ East Tustin Specific Plan area as Planned
Community Commercial/Business which encourages
26 mixed uses of professional office and
commercial uses.

2 Section 2 Amendment to East Tustin Specific Plan.

The City Council hereby approves Zone Change 96-002,
4 amending Subsection 4 of Section 3.7.3.C - Site
Development Standards for Commercial Uses, of the East
5 Tustin Specific Plan to read as follows, with the
additions in shaded print and deletions in strike-out:

Section 3 Severability.

13 If any section, subsection, sentence, clause,~phrase or
portion of this ordinance is for any reason held out to
14 be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not
15 affect the validity of the remaining portions of this
ordinance. The City Council of the City of Tustin hereby
16 declares that it would have adopted this ordinance and
each section, subsection, sentence, clause, phrase or
17 portion thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, phrases,
18 or portions be declared invalid or unconstitutional.

20 PASSED AND ADOPTED by the City Council of the City of
Tustin at a regular meeting held on the 3rd day of March,
21 1997.

number of the members of the City Council of the City of Tustin is
five; that the above and foregoing Ordinance No. 1179 was introduced at
at regular meeting of the City Council on February 18, 1997, and was
passed and adopted at a regular meeting of the City Council held on
March 3, 1997 by the following vote:
