Request: Authorization to vary with the front setback requirements
of the Planned Industrial District (PM).
RECOMMENDED ACTION
Approval of Variance No. 81-6 to allow a reduced front yard setback
(19') equivalent to the existing industrial building in the area, by
the adoption of Resolution No. 1997.
BACKGROUND
In December of 1979 the Planning Agency approved a variance and site
plan for construction of an industrial warehouse at 550 W. Sixth
Street. The action authorized a one foot rear yard setback in lieu
of the required ten foot setback.
After the variance approval, the owner Mr. Walter Foster, entered
into negotiations to purchase the City property along the western
boundary of the site. While negotiations have not been finalized,
Mr. Foster has submitted a revised site plan and variance request
which incorporates the additional land.
DISCUSSION
The development plans call for a 46,700 square foot warehouse
building to be set back nineteen feet (19') from the front property
line. The minimum setback required by the PM District is
~wenty-five feet (25'). The existing industrial structures along
Sixth Street are developed to the requested setback.
Parking is to be provided at a ratio of one space per 2,000 sq. ft.
of floor area for a total of 24. A loading dock on the west
building wall is to be provided.
The building elevations are designed to match the style of the
existing industrial structures along Sixth Street.

The City owned parcel was once considered for use as a water well
site. According to the City Attorney, the well site will be on the
Boy's Club property and therefore will not impact the layout of the
parking area.
CONCLUSIONS
Approval of the variance will allow building construction to the
same alignment as the existing industrial buildings on Sixth
Street. As a result, the variance approval will not
significantly impact the streetscape.
Approval of the site plan and of the building size should be
conditioned upon finalization of the purchase of the City
property by the applicant.
The 24 parking spaces would be sufficient to meet the needs of a
warehouse of this size, but not other industrial activities.
Restricting use of the structure for warehouse purposes should
be imposed as a condition of approval.

A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, APPROVING VARIANCE APPLICATION
NO. 81-6 TO AUTHORIZE A FRONT SETBACK OF
NINETEEN FEET (19') IN CONJUNCTION WITH AN
APPROVED REAR SETBACK OF ONE FOOT (1')
The Planning Agency of the City of Tustln does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application Variance No.81-6, was
filed on behalf of Walter Foster requesting
authorization to vary with the requirements of Planned
Industrial District to allow a front yard setback of
nineteen feet (19') and approve the site plan for
industrial development.
B. That a public hearing was duly called, noticed and
held on said application.
C. That because of special circumstances applicable to
the subject property, relative to size, shape, topo-
graphy, location or surroundings, a strict application
of the Zoning Ordinance is found to deprive subject
property of privileges enjoyed by other properties
enjoyed by other properties in the vicinity and under
identical zone classification, evidenced by the follow-
ing findings:
1. The use is in conformance with the land use
element of the Tustin Area General Plan.
2. The nineteen foot setback will bring the
development into conformance with the front setback
of the existing industrial buildings on Sixth Street.
D. That the granting of a variance as herein provided
will not constitute a grant of special privilege in-
consistent with the limitations upon other properties
in the vicinity and district in which the subject
property is situated.
E. That a Negative Declaration of significant
environmental impacts was previously approved by
Variance No. 79-7 (Resolution No. 1862).
F. That the granting of the variance as herein provided
will not be contrary to the intent of the Zoning
Ordinance or the public safety, health and welfare,
and said variance should be granted.

G. Proposed development shall be in accordance with the
development policies adopted by the City Council; Uni-
form Building Codes as administered by the Building
Official; Fire Codes as administered by the Orange
County Fire Marshal; and street improvement require-
ments as administered by the City Engineer.
H. Final development plans shall require the review
and approval of the Community Development Director.
II. Planning Agency hereby grants a variance as applied
for, to authorize the development of a 46,700 square foot
warehouse with a nineteen foot front setback subject
to the following conditions:

Approval of the site plan is conditioned upon the
acquisition of the 41.75' wide strip of land
currently owned by the City.
Prior to the issuance of a building permit a covenant
to hold multiple parcels as one shall be executed.
Any proposed improvements within the easement area of
the Metropolitan Water District shall be reviewed and
approved by that agency.
Street trees and treewells at 40' on centers shall be
provided.
Sidewalks shall be constructed to City Standard No.
104.

One 4' wide planter shall be provided in the parking
area perpendicular to the west property line.
Planting and irrigation plans shall be submitted to
the City for review and approval. On site planting
shall include:
4 - 24" box trees
5 - 15 gal. trees
- shrubs and ground cover in
all planters.

Ho Use of the structure is authorized for warehouse and
storage activities only. Manufacturing, assembly and
retail sales uses are not authorized.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency, held on the 17th day of August, 1981.
