NO. 2 8-17-81 Inter-Corn FROM: S USJ ECT: Honorable Mayor and City Council Members Community Development Department Zone Change 81-5 Recommended Action Staff recommends that the City~ouncil introduce Ordinance No. 858, by title only, approving Zone Change 81-5. Applicant: Location: Request: Joe A. Boswell 14351 Red Hill Avenue To change the zone from Duplex Residential (R-2) to Multi-Family Residential (R-3). BACKGROUND In December, 1980, the subject property was annexed into the City of Tustin subsequent to the adoption of Resolutions No. 80-103, 80-106. A single family dwelling currently occupies the lot, and is surrounded by multi-family residential units. Abutting on the rear and northerly side yard is a subdivision of duplex units, all of which front on Green Valley Drive. Along the southerly side yard, and fronting on Red Hill, is an apartment complex. On August 3, 1981, the Planning Agency adopted Resolution No. 1996 recommending the City Council approve the subject zone change. DISCUSSION It is felt that the applicant's request to rezone the subject location is both appropriate and viable. The character of the property (frontage on Red Hill and proximity to other R-3 zones) definitively lends itself to the flexibility the R-3 zone offers. Included in Planning Agency Resolution No. 1996, is a condition that provides that should the subject property be developed residential, a density level of one dwelling unit per 2,500 square feet of land area be imposed. Staff feels that such a condition is valid and should be maintained in any action taken by the Council. Zone Change 81-5 August 17, 1981 Page Two CONCLUSIONS Staff concludes that:' 1. An R-3 zone designation is in conformance with the Tustin Area General Plan. 2. The character of the subject property is such that the R-3 zone is appropriate and viable. e Consideration should be given to potential residential uses and therefore a density level of one unit per 2500 square feet should be imposed. The City Council finds and determines as follows: Ae That a proper application (Zone Change 81-5) was filed on behalf of Joseph A. Boswell for rezoning the property at 14351 Red Hill Avenue, from Duplex Residential (R-2) to Multi-Family (R-3). That the Planning Agency recommend approval of said application, after a public hearing had been duly called, noticed and held. That the City Council duly called, noticed and held a public hearing on said application. DJ That a Negative Declaration for the subject zone change has been applied for and hereby approved to conform with the requirements of the California Environmental Quality Act. That the R-3 zone is in conformance with the Tusttn Area General Plan. II. The subject property is hereby lrezoned to the Multi-Family Residential (R-3) and the Zoning Map of the City of Tustin amended accordingly subject to conditions of Planning Agency Resolution No. 1996.
