Minutes of Regular Meeting
July 20, 1981
The Planning Agency held a regular meeting Monday, July 20, 1981, at 3:00
p.m., in the Council Chambers of the City Hall, 300 Centennial Way, Tustin,
California.
The meeting was called to order by Chairman Sharp at 3:02 p.m.
The Pledge of Allegiance was led by Mrs. Kennedy and the Invocation was given
by Mr. Edgar.

The Minutes of the regular meeting held July 6, 1981 were approved as sub-
mitred.
PUBLIC HEARING
1. USE PEP4~IT 81-23
Applicant: George C. and Marvia H. Matthews
Location: 600 W. Sixth Street
Request: To expand the existing Pine Tree Pre-S~hool.
After the presentation of the staff report, the Public Hearing was opened
at 3:07 p.m. Seeing and hearing no one, the Public Hearing was closed.
Moved by Edgar, seconded by Kennedy, to approve Use Permit 81-23 by the
adoption of Resolution No. 1992.
Discussion followed that the signing will be on the wall surface and not
on the roof surface.
Motion carried 5-0. AYES~ Edgar, Hoesterey, Kennedy, Saltarelli, Sharp

PUBLIC CONCERNS
Michael Wandrick, 1891 Roanoke, Tustin~ thanked the Agency for his appointment
as Airport Volunteer.
Mrs. Kennedy requested that he look into flight patterns of Republic Airlines.

1. FINAL TRACT NO. 11282
Applicant: M. Petyo and Assoc. on behalf of Robert White
Location: 1370 San Juan Street
Request: One lot subdivision for condominium purposes on .33 acres.
9 residential units are proposed.

AGENCY CONCERNS
.~lr. Saltarelli asked when the construction at Irvine and Newport would be com-
pleted.
Bob Ledendecker, City Engineer, responded that this was the traffic signal
interconnect project and the pole should be set and the sidewalk replaced in
the next two weeks.
ADJOURNMENT
Moved by Kennedy, seconded by Edgar, to adjourn at 3:17 p.m. to the 7:30 p.m.
meeting. Carried 5-0.

The Planning Agency was called to order at 7:39 p.m. and all were present.
PUBLIC HEAPING

Six Star Cablevision

Install 60 foot antenna and earth station discs and a 10 x 20
foot equipment building.
Mike Brotemarkle, Community Development Director, gave the staff report
and s,,m~arized that they want to exceed the 50 ft. height limitation that
is allowed in a Planned Industrial District for a radio tower by 10 ft.
Property owners within .300 ft. of the site, which included 3 or 4 homes,
an apartment and the School District, were notified by mail.
The Public Hearing was opened at 7:45 p.m.
Robert Patty, General Manager for Six Star Cablevision, explained that it
was necessary to have a site in Tustin. Their engineers have focused on
design and will work with staff to achieve an aesthetic site. The discs
are 7 meters or 20'+ height on earth stations. The discs are adjustable
but will be placed in a stationary position. The microwave disc at the
top of the antenna is 6 to 8 feet in diameter. In response to Mr. Edgar's
suggestion, Mr. Patty said they would explore the possibility of putting
the earth station discs below ground level but drainage may be a problem.
There is no radiation problem with this equipment. The antenna and discs
do not have to be on the same site but it would be preferable.
The following spoke in opposition to the Use Permit because they felt this
would be an attractive nt%isance and cause their property to depreciate.

Mr. O'Malley presented a petition with approximately 80 signatures in
· opposition to this Use Permit.
Gloria Steinmeyer, 17332 Amaganset Way, questioned the integrity of the
company because they ~maged trees and a coral pot on her property while
putting cable on utility poles and the matter has not been settled to her
satisfaction. Mr. Patty admitted that there was damage but said they
could not put a price on the loss of shade. They are willing to replace
the coral pot.

It was moved by Kennedy, seconded by Edgar, to deny Use Permit 81-24.
Mr. Edgar stated that he understood the legality of notifying all property
owners within 300 feet but thought we should have notified the entire
tract.
Mr. Saltarelli co~uented that the arguments against the Use Permit are
primarily e~otional and not factual. He suggested that Six Star should
explore alternatives that would lessen the impact on the neighborhood such
as the possibility of excavating for the discs, putting in a tall fence
and buffering it, and perhaps putting the antenna on top of a tall build-
ing at another location. A substitute motion was made by Hoesterey, sec-
onded by Saltarelli, to continue this Public Hearing in a closed mode to
the next m~eting so that all alternatives can be explored.
Mrs. Kennedy opposed this site because it is School District property with
residential on two sides. She prefers this equipment to be out frc~ the
residential area of t_he City. She was opposed to helping private industry
find a site.
Mr. Edgar opposed the substitute motion because he felt continuation
implied a co-~tment to this particular site.
Substitute motion carried 3-2, Edgar and Kennedy oDDosed.
Mrs. Kennedy asked that the public be informed that this hearing is con-
tinued. She will be on vacation for the next meeting which will affect
the vote on the issue. It was moved by Kennedy, seconded by Edgar, that
because of the complexity of this issue and to give Six Star time to
explore alternatives, this be continued to August I7 instead of August 3.
Mr. Saltarelli favored the two week extension because there doesn't seem
to be a great deal of sympathy to this site location unless major modifi-
cations can be made and to prolong the residents' concern about the site
and delaying the applicant in finding a new site is not best. Mr. Patty,
representative for the applicant, favored the two-week period.
The motion failed 1-4, Edgar, Hoestere¥, Saltarelli and Shard opDosed.
It was m~ved by Edgar, seconded by Hoesterey, to adjourn at 9:16 p.m. to the
next regular meeting on August 3, 1981. Carried 5-0.
